Raffles shall be legal within the Borough of Stone Harbor, provided
that the same are operated in accordance with the provisions of N.J.S.A. 5:8-50
et seq.
As used in this article, the following terms shall have the meanings
indicated:
A game of chance played by drawing for prizes or the allotment of
prizes by chance, by selling shares or tickets or rights to participate in
such game and by conducting the game accordingly, when the entire net proceeds
of such game are to be devoted to educational, charitable, patriotic, religious
or public-spirited uses, and, in the case of senior citizen associations and
clubs, to the support of these organizations.
Eligible organizations are bona fide organizations or associations of
veterans of any war in which the United States has been engaged, churches
or religious congregations and religious organizations, charitable, educational
and fraternal organizations, civic and service clubs, senior citizen associations
and clubs, and officially recognized volunteer fire companies and rescue squads.
No person or organization shall operate a raffle within the Borough
of Stone Harbor without obtaining a license from the Borough.
A.
An applicant desiring to conduct a raffle within the Borough
of Stone Harbor shall file a written application with the Borough Clerk in
the form prescribed by applicable state laws and regulations. Such form shall
be available in the Borough Clerk's office along with a general explanation
of the procedures required for issuance of a license.
B.
All applicants for such licenses shall be qualified to obtain
such in accordance with state laws and regulations, and shall, at the time
of submission of the application for license, have obtained a state registration
number.
All qualified organizations (as defined in N.J.S.A. 5:8-51 and N.J.A.C.
13:47-1.1) to be issued a raffles license shall be exempt from payment of
any municipal licensing fee. However, nothing in this section shall be construed
as exempting such organizations from payment of any fee due the New Jersey
Division of Consumer Affairs, Legalized Games of Chance Control Commission,
as set forth in N.J.S.A. 5:8-53 and N.J.A.C. 13:47-4.9 as the same may be
amended and supplemented from time to time.
No raffle shall be conducted in the Borough except in compliance with this section. Any person, entity, etc., conducting a raffle without first complying with the provisions of this section shall be in violation of this section, and subject, upon conviction for such violation, to the penalties set forth in Chapter 1, Article III, Penalty, of the Borough of Stone Harbor Code, for other than a first offense.
