The purpose of this article is to protect the
safety and health of the inhabitants of the Village, to establish
safeguards for the keeping of animals and poultry within the Village
and to provide for penalties for the violations thereof.

No person shall keep or harbor any chickens,
ducks, geese or other domesticated fowl in the Village, except in
the RU Rural District and RT Residential Transitional District, not
closer than 200 feet to any house, except the owner's, apartment building,
church, school, hospital or any other building customarily used or
occupied by human beings, such as but not limited to stores, hotels,
restaurants, offices and factories.
No person shall keep or harbor any cattle, horses,
sheep, goats, pigs or swine in the Village except as follows:
A. Cattle, horses and sheep may be kept in the Village
if maintained not closer than 100 feet to any house, except the owner's,
apartment building, church, school, hospital or any other building
customarily used or occupied by human beings, such as but not limited
to stores, hotels, restaurants, offices and factories.
B. Goats, pigs or swine may be kept in the RU Rural District
and RT Transitional Residential District, not closer than 500 feet
to any house, except the owner's, apartment building, church, school,
hospital or any other building customarily used or occupied by human
beings, such as but not limited to stores, hotels, restaurants, offices
and factories.

C. Every person maintaining animals as permitted in paragraph
1 of this section shall keep clean and sanitary every shed, barn or
structure housing said animals. Every such shed, barn or structure
shall be thoroughly cleaned at least once every 24 hours, and refuse
from the same shall, when collected, be kept in covered containers
until disposed of in accordance with any other provisions of this
Code.
No person shall pasture or cause to be driven
for the purpose of pasture any animals upon the grass or herbage growing
upon or along the streets, highways or other public places within
the Village.

A. No person shall maintain any establishment for hire
or profit within the Village for the raising, training, boarding or
selling of cats or any establishment where more than three cats are
harbored or kept.
B. Notwithstanding the foregoing, the owner of a female
cat may keep upon his premises the litter of such cat for a period
not to exceed four months.
C. Birds and other domesticated pets may be maintained
as pets if kept in a clean and sanitary manner and are not offensive
or dangerous.

No person owning, harboring or keeping any cat,
animal or fowl shall suffer, permit or allow such creature to disturb
the peace and quiet of the neighborhood or other persons by yowling,
barking, howling or making other loud or unusual noises for or at
an unreasonable period of time or in an unreasonable manner, nor shall
such person suffer, allow or permit such creature to conduct itself
in such a manner as to habitually annoy any other person.

No person owning, keeping, harboring or having
the care, custody and/or control of any cat, animal or fowl shall
suffer, permit or allow such creature to commit any nuisance in any
public street, building, or park or any private property except with
the consent of the owner thereof.

The animal control officer of the Village of
Millbrook shall be the Enforcement Officer.

A violation of this article is hereby declared to be an offense punishable, upon conviction, as provided in Chapter
1, General Provisions, Article
III.
