Editor's Note: This chapter was originally derived from Sec. 9.68 of the Charter of the City of Newburgh, as renumbered by L.L. No. 2-1952, adopted 3-3-1952. Section 1BB of L.L. No. 4-1987, adopted 9-14-1987, provided that these water pollution provisions be deleted from the Charter and transferred to a separate chapter of the Code of the City of Newburgh.
It shall not be lawful for any person to throw or deposit or cause to be thrown or deposited into any pond, lake, spring, aqueduct or reservoir, owned or used or hereafter to be owned or used by the City of Newburgh, or into any stream of water taken or to be taken, in whole or in part, for the purposes of providing a supply of water to the City of Newburgh any dead animal or other offensive matter or anything whatever.
Any person offending against the provisions of this chapter shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine or imprisonment or both, in the discretion of the court, such fine not to exceed $100 and such imprisonment not to exceed a period of three months.
