[HISTORY: Adopted by the Board of Trustees of the Village of North Syracuse 1-28-1999 by L.L. No. 1-1999 as Ch. 57 of the 1999 Code. Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
INTENT TO CONSUME
Drinking from the container, with alcohol on the breath of the possessor and/or any circumstances evidencing an intent to ultimately consume on any public street, public highway or public place.
OPEN BOTTLE OR CONTAINER
A bottle or container with the contents exposed to the atmosphere or the seal thereof broken.

The drinking of liquor, beer, wine or other alcoholic beverages on any public street, public highway or public place within the Village is prohibited, and no person shall consume or have in his possession with intent to consume on any public street, public highway or public place, except those places duly licensed for sale and consumption of alcoholic beverages on the premises, any open bottle or container containing liquor, beer, wine or other alcoholic beverage. The provisions of this section shall not be deemed to prohibit such conduct at functions or events previously registered or approved by the Village Board.

Any violation of any provision of this chapter shall be punishable by a maximum fine of $250 or a term of imprisonment not to exceed 15 days, or both.
