This article is enacted by the Town of Ogden for the purpose of providing continuous and timely service to the public from all departments within the Town of Ogden and further to provide for prompt and continuous administration of all departments of the Town of Ogden during the absence or disability of any of the designated department heads.
This article shall be known and may be cited as the "Deputy Department Head Law of the Town of Ogden."
As used in this article, the following terms shall have the meanings indicated:
DEPARTMENT HEAD
Includes the named and designated director or head of all departments presently existing within the Town of Ogden, together with such other departments which may in the future exist or be created by the Town of Ogden.

The Town Board of the Town of Ogden shall have the power, pursuant to this article and the provisions of § 53-b of the Town Law of the State of New York, to appoint and designate, in its discretion, a deputy department head for each of the departments of the Town of Ogden which presently exists or which in the future may exist or be created by the Town Board. Each deputy department head shall hold office until the first day of January next succeeding the first biannual Town election held after the deputy department head's appointment and thereafter shall hold office for the term of one year and until the deputy department head's successor shall have qualified; provided, however, that the appointments to such offices shall be revocable at the pleasure of the Town Board. The Town Board shall fix the compensation, if any, to be received by each deputy.
Such deputy department heads shall have the power and authority to act generally for and in place of their principals and shall likewise assume and carry out the duties and responsibilities of their principals in the event of the absence or disability of such department head.
The office of such deputy department head shall be in the exempt class of the civil service, pursuant to the provisions of § 53-b of the Town Law of the State of New York.
Each deputy shall, before entering upon the duties of the deputy's office, take and file with the Town Clerk an oath of office. The Town Board may require a deputy to file a bond for the faithful performance of the deputy's duties.

On and after January 1, 1981, the Town Clerk of the Town of Ogden may be appointed by the Town Board of the Town of Ogden as the Receiver of Taxes and Assessments for the Town of Ogden, and the Town Clerk shall, upon such appointment, perform the functions of both of such offices.
