§ 6-1 Authorization.

The Supervisor of the Town of Tonawanda, by and through the Executive Director of the Town of Tonawanda Development Corporation, is hereby authorized and directed to prepare and submit an application to the New York State Commissioner of Economic Development for designation of an area within the jurisdiction of the Town of Tonawanda as a New York State Economic Development Zone.

§ 6-2 Designation.

The Town Assessor of the Town of Tonawanda is hereby designated as the official who shall serve as the Local Zone Certifier. Said Certifier shall have such powers and duties as authorized by New York State General Municipal Law, Article 18-B.

§ 6-3 Boundaries.

The boundaries of the proposed Town of Tonawanda Economic Development Zone are as follows:
A. 
Parcel A.
All that tract or parcel of land situate in the Town of Tonawanda, County of Erie and State of New York, being part of Township 12, Range 8, and part of Farm Lots 91, 92 and 93 on the Mile Strip of the New York State Reservation on the Niagara River and part of Farm Lots 43 through 46, inclusive, as shown on the Holland Land Company's Survey, and more particularly bounded and described as follows:
BEGINNING at a point on the northerly line of Woodward Avenue, a distance of 249 feet more or less west of the intersection of the northerly line of Woodward Avenue (being 60.0 feet wide) and the westerly line of Military Road (being 83.0 feet wide), said point also being the southeasterly corner of SBL 65.12-1-33, Map Cover 317; thence northerly along the easterly line of SBL 65.12-1-33, a distance of 388 feet more or less to the northeast corner of SBL 65.12-1-33; thence westerly along the northerly line of SBL 65.12-1-33, a distance of 447 feet more or less to the northwesterly corner of SBL 65.12-1-33; thence northerly, a distance of 1,272 feet more or less to the northwesterly corner of SBL 65.12-1-23.11, Map Cover 317; thence easterly along the northerly line of SBL 65.12-1-23.11, a distance of 709 feet more or less to a point, said point also being the westerly line of Military Road (being 83 feet wide), and the northeasterly corner of SBL 65.12-1-23.11, Map Cover 317; thence northerly along the westerly line of Military Road, a distance of 8,460 feet more or less to a point, said point being the corporate boundary of the Town of Tonawanda and the northeast corner of SBL 52.12-6-12.1, Map Cover 2308; thence westerly along the corporate boundary of the Town of Tonawanda, a distance of 466 feet more or less to the northwest corner of SBL 52.16-6-11, Map Cover 2308; thence southerly along the westerly line of SBL 52.16-6-11, a distance of 1,516 feet more or less as extended to a point on the northerly line of SBL 52.16-1-3; thence westerly along the northerly line of SBL 52.16-1-3, a distance of 3,810 feet more or less to the northwesterly corner of SBL 52.16-1-3; thence southerly along the westerly line of SBL 52.16-1-3, a distance of 754 feet more or less to the southwesterly corner of SBL 52.16-1-3; thence westerly, a distance of 634 feet more or less to the easterly line of Two Mile Creek Road (being 66 feet wide); thence northerly along the easterly line of Two Mile Creek Road, a distance of 762 feet more or less to the corporate boundary of the Town of Tonawanda, Farm Lot 91 on the Mile Strip of the New York State Reservation; thence northwesterly along the corporate boundary of the Town of Tonawanda, a distance of 4,998 feet more or less to a point of intersection with the southerly line of River Road (varied width), said point also being the northeasterly corner of SBL 52.06-3-4, Farm Lot 91 on the Mile Strip of the New York State Reservation; thence southeasterly across the New York State Thruway (I-190), a distance of 2,216 feet more or less to a point, said point being the easterly line of the New York State Thruway (I-190) and the northwesterly corner of sublot 255, Map Cover 1300; thence southeasterly along the easterly line of New York State Thruway (I-190), a distance of 1,708 feet more or less to a point of intersection with the westerly line of Cooper Avenue (being 60 feet wide); thence northeasterly along the westerly line of Two Mile Creek Road, a distance of 1,143 feet more or less to the northeasterly corner of SBL 65.06-3-34.2, Map Cover 497; thence westerly along the northerly line of SBL 65.06-3-34.2, a distance of 158 feet more or less to the southwesterly corner of SBL 65.06-3-11, Map Cover 497; thence northeasterly, a distance of 1,463 feet more or less to the southerly line of Ensminger Road (being 90 feet wide); thence northeasterly, a distance of 108 feet more or less to the southwesterly corner of SBL 52.18-2-1; thence northeasterly, a distance of 258 feet more or less to the northwesterly corner of SBL 52.18-2-22, Map Cover 2143; thence northwesterly along the southerly line of SBL 52.18-2-21, Map Cover 2143, a distance of 180 feet more or less to the southwesterly corner of SBL 52.18-2-21; Parcel B.
All that tract or parcel of land situate in the Town of Tonawanda, County of Erie and State of New York being part of Farm Lot 99 on the Mile Strip of the New York State Reservation and more particularly bounded and described as follows:
BEGINNING at a point on the northeasterly corner of SBL 65.18-1-2, Farm Lot 103 on the Mile Strip of the New York State Reservation; thence northwesterly across Farm Lot 102, a distance of 1,473 feet more or less to the westerly corner of SBL 65.17-1-1, Farm Lot 101 on the Mile Strip of the New York State Reservation; thence southwesterly along the southerly line of SBL 65.17-1-1, a distance of 1,060 feet more or less to a point; thence northwesterly, a distance of 747 feet more or less to the southeasterly corner of SBL 65.14-1-3, Farm Lot 101 on the Mile Strip of the New York State Reservation; thence southwesterly, a distance of 2,692 feet more or less to a point on the easterly line of River Road (being 66 feet wide); thence southeasterly along the easterly line of River Road, a distance of 871 feet more or less to the southeasterly corner of SBL 65.17-1-1, Farm Lot 101 on the Mile Strip of the New York State Reservation; thence northeasterly along the southerly line of SBL 65.17-1-1, a distance of 1,949 feet more or less to a point; thence southeasterly across Farm Lot 102, a distance of 1,353 feet more or less to the northeasterly corner of SBL 77.23-1-1.1, Map Cover 288; thence northeasterly, a distance of 1,740 feet more or less to the northeasterly corner of SBL 65.18-1-2 and the point and place of beginning, containing 113 +/- acres.
C. 
Parcel C.
All that tract or parcel of land situate in the Town of Tonawanda, County of Erie and State of New York, being part of Farm Lots 101, 102 and 103 on the Mile Strip of the New York State Reservation and more particularly bounded and described as follows:
BEGINNING at a point of intersection with the easterly line of River Road (being 66 feet wide) and the northwesterly corner of SBL 65.13-1-1.1, Farm Lot 99 on the Mile Strip of the New York State Reservation; thence northeasterly and parallel to the southerly line of Sawyer Avenue (being 66 feet wide), a distance of 3,563 feet more or less to the northeast corner of SBL 65.09-6-3, Farm Lot 99 on the Mile Strip of the New York State Reservation; thence southeasterly along the westerly line of SBL 65.09-6-3, a distance of 684 feet more or less to the southeasterly corner of SBL 65.09-6-3; thence southwesterly, a distance of 3,503 feet more or less to a point on the easterly line of River Road; thence northerly along the easterly line of River Road, a distance of 962 feet more or less to the northwesterly corner of SBL 65.13-1-1.1 and the point and place of beginning, containing 67 +/- acres.

§ 6-4 Administrative Board.

A. 
The composition of the Local Economic Development Zone Administrative Board shall be as follows:
(1) 
The Supervisor of the Town of Tonawanda.
(2) 
A representative of the Town Board of the Town of Tonawanda.
(3) 
Director of the Town of Tonawanda Department of Community Development.
(4) 
The President of the Town of Tonawanda Development Corporation (TTDC) as a representative of local business.
(5) 
A representative of the banking/financial community of Western New York.
(6) 
A representative of organized labor.
(7) 
A representative of the residents located within the proposed zone boundaries.
(8) 
A representative of community organizations.
(9) 
A representative of local educational institutions.
(10) 
A representative of social service organizations.
(11) 
A representative of a job training organization.
B. 
The Supervisor of the Town of Tonawanda is hereby designated to serve as the Chairman of the Local Economic Development Zone Administrative Board, and said Board shall have such powers and duties as authorized by the New York State General Municipal Law, Article 18-B.
