[HISTORY: Adopted by the Town Board of the Town of Tonawanda 7-15-1974 as Chapter 28 of the 1974 Code of the Town of Tonawanda; amended in its entirety 4-19-2021 by L.L. No. 1-2021. Subsequent amendments noted where applicable.]
No person shall participate in any parade, demonstration, public gathering or assembly within the Town of Tonawanda, outside the corporate limits of the Village of Kenmore, upon any street, highway, sidewalk, square, demonstration, public gathering or assemblage has not been authorized by a written permit issued by the Town Clerk after review by the Town of Tonawanda Police Department as set forth herein.
As used in this chapter, the following words, terms or phrases shall have the meanings indicated:
DEMONSTRATION
A public display of a group's or individual's feeling(s) toward a person(s) idea, cause, etc., including, but not limited to, marches, protests, student walk-outs, assemblies and sit-ins. Such events and activities usually attract a crowd of persons including participants, onlookers, observers, media and other persons who may disagree with the point of view of the activity. The term does not include casual activity by persons which does not have the intent or propensity to attract a crowd of onlookers.
PARADE
An event held on public streets or highways in the Town of Tonawanda, outside of the Village of Kenmore limits.
A. 
The applicant shall be provided with an application to be completed and returned to the Town Clerk or police department in a timely manner as set forth in the application. A copy of the rules and guidelines for said event shall be furnished to the applicant. If the permit is denied by the Town Clerk after review by the police department, the applicant may file a written appeal with the Town Attorney within five business days of the denial. The Town Attorney shall make a written decision within five business days of the receipt of said appeal and file it with the Town Clerk.
B. 
The Chief of Police may promulgate rules and guidelines to enforce the implementation of this chapter.
The Town of Tonawanda Police Department shall be responsible for the enforcement of this chapter.
A. 
Any violation by a person, firm or corporation of any provision of this chapter shall be deemed a violation punishable by a fine not to exceed $250 or by imprisonment for a period not to exceed 15 days, or both.
B. 
Any person who takes part in or assists in any violation of this chapter shall also be subject to the penalties provided herein.
C. 
Each day that a violation of this chapter is committed or permitted to exist shall constitute a separate offense.
