This article is intended to promote and improve the health, safety and
general welfare of the community by regulation of the parking areas and driveways
of Kenmore Mercy Hospital, Town of Tonawanda, New York. This article is enacted
pursuant to a written request by the chief administrator of the hospital and
is authorized by § 1660-a of the Vehicle and Traffic Law of the
State of New York.
This article shall only apply to the parking areas and driveways of
Kenmore Mercy Hospital, 2950 Elmwood Avenue, Town of Tonawanda, New York.
It will be the responsibility of Kenmore Mercy Hospital to place and
maintain traffic signs and pavement markings in compliance with the provisions
of this article. Traffic signs and pavement markings shall conform to the
provisions of this article indicating the special regulations applicable to
each location and shall be installed in accordance with the New York State
Traffic Commission's Manual of Uniform Traffic Control Devices.
A.
Stopping, standing or parking. No person or firm shall
stop, stand or park a vehicle at any time, whether occupied or not, except
when necessary to avoid conflicts with other traffic or in compliance with
the direction of a police officer or traffic control device or signal, in
the following areas:
(1)
Hospital ambulance entrance: Along the curb on the west
side of the hospital ambulance entrance, from the north side of the hospital
building to a point 50 feet north of the building; thence from this point
following the curb westerly to the no-standing sign 175 feet west of this
point.
(2)
West entrance road: On the south side of the west entrance
road, from a point 913 feet east of the east curbline on Military Road to
a point 940 feet east of the east curbline of Military Road (entrance to heliport
driveway).
(3)
West side of the hospital parking lot: On the west side
of the hospital parking lot, from a point 53 feet south of the south curbline
of the west entrance road to a point 86 feet south of the south curbline of
the west entrance road (entrance to heliport driveway).
B.
Parking. No person or firm shall park a vehicle at any
time, whether occupied or not, but may temporarily stop or stand for the purpose
of and while actually engaged in receiving or discharging merchandise or passengers,
in the following areas:
(1)
North entrance road. Along the curb on the north side
of the north entrance road, from the west curbline of Elmwood Avenue to a
no-parking sign 265 feet west of the west curbline of Elmwood Avenue.
(2)
Loading dock. From the no-parking sign immediately north
of the loading dock northerly along the curb to a point 57 feet north of that
sign.
(3)
Loading dock area. Along the curbline on the south side
of the loading dock area (on the west side of the building), from a point
on that curb even with the west side of the chimney westerly to a point 59
feet west of the chimney.
(4)
South entrance road. From a point 215 feet west of the
west curbline of Elmwood Avenue along the north curb of the south entrance
road for 148 feet, ending at a point along the entrance road to the management
parking lot, a total distance of 363 feet from the curbline of Elmwood Avenue.
(5)
Hospital parking lot. Along the curb on the south side
of the hospital parking lot, from the southwest corner of the parking lot
to a point 588 feet east of the southwest corner.
(6)
Management parking lot. From the north curbline of the
exit from the management parking lot (on the south side of the building),
along the exterior curb, first northerly then following the curb for a total
of 330 feet, ending at a point near the boiler room on the west side of the
hospital.
(7)
Main lobby. Between the no-parking signs in front of
the main lobby.
(8)
In the circular main entrance to the McAuley residence.
Located on the north side of the building running south from the west entrance
road to Kenmore Mercy Hospital.

A.
Pavement markings. The parking of vehicles in the parking
areas or driveways of Kenmore Mercy Hospital shall only be permissible within
the pavement markings established for such purposes.
B.
Parallel parking. Only parallel parking of vehicles,
within the pavement markings established for that purpose, will be allowed
along the curb on the north side of the north entrance road, from a point
265 feet west of the west curbline of Elmwood Avenue to a point 380 feet west
of the west curbline.
C.
Parking for the handicapped. Only vehicles transporting
handicapped persons shall be parked within the pavement markings along the
curb on the north side of the north entrance road, from a point 380 feet west
of the west curbline of Elmwood Avenue to a point 409 feet west of the west
curbline.
The maximum speed at which vehicles may proceed on or along any of the
driveways or in any of the parking areas of Kenmore Mercy Hospital property
shall be 20 miles per hour.
This article shall be enforced by the Town of Tonawanda Police Department,
in the manner provided by law, rule or regulation for the enforcement of traffic
or parking ordinances, laws or rules in the town, including the use of tags,
summonses and towing. Any vehicle towed under the authority of this section
will not be released to its owner until the owner has paid the reasonable
cost of towing and storing the vehicle.
The Chief of Police shall have the power to promulgate rules and regulations
designed to effectuate the goals of this article.
A violation of this article shall constitute a traffic infraction within
the meaning of § 1800 of the Vehicle and Traffic Law of the State
of New York.
Every person convicted of a traffic infraction for a violation of this
article shall be punished by a fine of not more than $50; and for a second
or subsequent conviction within 18 months thereafter by a fine of not more
than $100 for each violation.
