A.
No unauthorized person shall uncover, make any connections
with or opening into, use, alter or disturb any public sewer or appurtenances
thereof without first obtaining a written permit from the Plumbing
Inspector.
B.
Where any undertaking involves the discharge of any
industrial wastes, including cooling waters or other lightly contaminated
waters into the sewer system, an industrial waste permit is also required
to be issued by the Pretreatment Administrator. No discharge of any
quantity or type of industrial wastes into the sewer system is authorized
without the issuance of such permit or formal written communication
from the Pretreatment Administrator advising that such a permit will
not be required.
B.
For connections from residential buildings, the sewer
connection permit will be issued by the Plumbing Inspector.
C.
For permits involving wastewater discharges from commercial
establishments, the sewer connection permit will be issued by the
Plumbing Inspector after consultation with the Pretreatment Administrator.
D.
For discharges of wastewater from industrial facilities,
a sewer connection permit will be issued by the Plumbing Inspector
and any discharge of industrial wastes will be governed by an industrial
waste permit, if deemed necessary by the Pretreatment Administrator.
E.
Each permit application shall be supplemented by any
plans, specifications or other information considered pertinent in
the judgment of the permit issuer.
A.
All costs and expenses incident to the installation
and connection of the building sewer shall be borne by the owner.
The owner shall indemnify the Town of Tonawanda from any loss or damage
that may, directly or indirectly, be occasioned by the installation
of the building sewer.
B.
The owner shall be responsible for the maintenance
and repairs of the sanitary sewer lateral and apparatus within the
confines of any building, dwelling or structure.
C.
When sanitary sewer laterals become inoperative due
to plugging, breaks, settling, etc., it shall be the owner's responsibility
to repair the same up to and including the wye connection at the Town
of Tonawanda sanitary sewer main.
A separate and independent building sewer shall
be provided for every building in residential and commercial areas;
except that where one building stands at the rear of another on an
interior lot and no private sewer is available or can be constructed
to the rear building through an adjoining alley, court, yard or driveway,
the building sewer from the front building may be extended to the
rear building and the whole considered as one building sewer.
Old building sewers may be used in connection
with new buildings only when they are found, on examination and tested
by the Plumbing Inspector, to meet all requirements of this Part 1,
including the exclusion of surface stormwater.
The size, slope, alignment, materials of construction
of a building sewer and the methods to be used in excavating, placing
of pipe, jointing, testing and backfilling the trench shall all conform
to the requirements of the Building and Plumbing Code[1] or other applicable rules and regulations of the Town
of Tonawanda. In the absence of code provisions or in amplification
thereof, the materials and procedures set forth in appropriate specifications
of the American Society for Testing and Materials and Water Pollution
Control Federation Manual of Practice No. 9 shall apply.
Whenever possible, the building sewer shall
be brought to the building at an elevation below the basement floor.
In all buildings in which any building drain is too low to permit
gravity flow to the public sewer, sanitary sewage carried by such
building drain shall be lifted by an approved means and discharged
to the building sewer or the building drain may be hung on the cellar
wall and shall not be less than four inches in size.
No person shall make connection of roof downspouts,
exterior foundation drains, areaway drains or other sources of surface
runoff or groundwater to a building sewer or building drain, which
in turn is connected directly or indirectly to a public sanitary sewer.
The connection of the building sewer into the
public sewer shall conform to the requirements of the Building and
Plumbing Code[1] or other applicable rules and regulations of the Town
of Tonawanda or the procedures set forth in appropriate specifications
of the American Society for Testing and Materials and Water Pollution
Control Federation Manual of Practice No. 9. All such connections
shall be made gastight and watertight. Any deviation from the prescribed
procedures and materials must be approved by the Plumbing Inspector
before installation.
The applicant for the building sewer permit
shall notify the Plumbing Inspector when the building sewer is ready
for inspection and connection to the public sewer. The connection
shall be made under the supervision of the Plumbing Inspector.
All excavations for building sewer installation
shall be adequately guarded with barricades and lights so as to protect
the public from hazard. Streets, sidewalks, parkways and other public
property disturbed in the course of the work shall be restored in
a manner satisfactory to the Town of Tonawanda.
Costs for saddles, taps and other equipment
or appliances, including labor, related to Town sewer service shall
be established by resolution of the Town Board. Said established costs
may be from time to time amended, supplemented, changed, modified
or repealed by the Town Board by resolution after a public hearing
in relation thereto in which parties in interest and citizens shall
have an opportunity to be heard; at least 10 days' and not more than
20 days' notice of the time and place of such hearing shall be published
in a paper of general circulation in the Town of Tonawanda. A copy
of such resolution shall be filed in the office of the Town Clerk
of the Town of Tonawanda and shall be incorporated into the Town of
Tonawanda Sewer Use Local Law.
