A scale of annual charges is hereby established and imposed in the Town of Tonawanda for the use of its sanitary sewer system or any part or parts thereof
[Amended 12-1-1980 by L.L. No. 8-1980]
Such charges shall be computed quarterly and shall be based either upon the charge for consumption of water on the premises connected with and served by the sewer system or such part or parts thereof or based upon the outflow of sewage from the premises connected with and served by the sewer system or such part or parts thereof.
Said sewer rents shall be due and payable quarterly and shall accompany the water bill to the premises connected with and served by the sewer system or such part or parts thereof.

Penalties for late payment of sewer rents shall be as follows: 10% for bills paid later than 30 days following the due date of each quarter.
A. 
Such unpaid rents, together with the penalties described by Part 2 of this chapter, shall be a lien upon the real property connected with and served by the sewer system or such part or parts thereof, and such a lien is prior and superior to every other lien or claim except the lien of an existing tax, assessment or other lawful charge imposed by or for the state or a political subdivision or district thereof.
B. 
The Town Board may bring and maintain an action in the name of the Town for the foreclosure of such liens for such sewer rents, or such Board may certify to the Town Clerk the amount of any such lien which has not been paid at the time and in the manner prescribed by Part 2 of this chapter, with a description of the real property affected thereby, and the Town Board may include such amount in the annual tax levy and shall levy the same upon the real property in default.

Sewer rent charges shall be established by resolution of the Town Board.
