For the purpose of this chapter, words and terms used herein are defined as follows:
APPLICANT
Any person, firm, partnership, corporation or any other entity applying to the Town Board for subdivision approval; an applicant is sometimes referred to herein as an "owner" or "subdivider."
CODE ENFORCEMENT OFFICER
The Code Enforcement Officer of the Town of Tonawanda, New York.

COMPREHENSIVE PLAN
A long-range or Master Plan for the development of the town.
CONDITIONAL APPROVAL OF FINAL PLAT
Approval of a final plat is subject to conditions set forth by the Town Board in a resolution conditionally approving such plat. Conditional approval does not qualify as final plat for recording nor authorize issuance of building permits prior to final plat approval.
FINAL PLAT
A drawing, in final form, showing a proposed subdivision containing information or detail required by this chapter to be presented to the Town Board for approval and which, after final plat approval, may be duly filed or recorded by the applicant in the office of the County Clerk.
FINAL PLAT APPROVAL
The signing of a final plat by a duly authorized officer after a resolution granting final approval to the plat or after conditions specified in a resolution granting conditional approval of the plat are completed. Such final approval qualifies the plat for recording in the office of the County Clerk.
LOCAL WATERFRONT REVITALIZATION PLAN
A Comprehensive Plan which refines legislatively established waterfront policies and programs.
OFFICIAL SUBMISSION DATE
The date on which an application for plat approval, complete and accompanied by all required information, endorsements and fees, has been filed with the Town Clerk.
PERSON
An individual, partnership, association, society, syndicate, trust, company, firm or corporation or any other entity.
PRELIMINARY PLAT
A drawing or drawings clearly marked "preliminary plat," showing the layout of a proposed subdivision, submitted to the Town Board for approval prior to submission of the plat in final form and containing at least the required information specified in Article IV of this chapter in sufficient detail to apprise the Town Board of the details of the proposed subdivision.
RESUBDIVISION
The further division of lots, plots, sites or other division of land or the relocation of lot lines of any lot within a subdivision previously made and approved or recorded according to law or changes in the lines of existing streets, highways or public areas within any such subdivision; but not including conveyances made so as to combine existing lots by deed or other instrument.
ROAD, MAJOR
A road intended to serve heavy flows of traffic from minor roads or as a business road providing access to business properties. Roads anticipated to carry truck traffic as defined by the Town Engineer, greater than 3% of the average daily traffic, shall be defined as a major road for design purposes.
ROAD, MINOR
A road intended to serve primarily as an access to abutting residential properties.
SKETCH PLAN
A sketch of a proposed subdivision to enable the applicant to save time and expense in reaching general agreement with the Town Board as to the form of the layout and objectives of this chapter.
SUBDIVIDER
A person proposing to subdivide real property in the Town of Tonawanda, New York.
SUBDIVISION
The division of any parcel of land into two or more lots, blocks or sites for the purpose of conveyance, transfer of ownership, improvement, building redevelopment or sale. The term "subdivision" shall include "resubdivision" and includes any alteration of lot lines or dimensions of any lots or sites shown on a plat previously approved and filed in the office of the County Clerk.
SUBDIVISION, MAJOR
A subdivision containing four or more lots or any subdivision requiring new public improvements.
SUBDIVISION, MINOR
A subdivision containing fewer than four lots, fronting on an existing road and not requiring new public improvements.
TOWN BOARD
The Town Board of the Town of Tonawanda, New York.
TOWN BUILDING DEPARTMENT
The Building Department of the Town of Tonawanda, New York.
TOWN CLERK
The Town Clerk of the Town of Tonawanda, New York.
TOWN ENGINEER
The Town Engineer of the Town of Tonawanda, New York.
TOWN FISCAL OFFICER
The Supervisor of the Town of Tonawanda, New York.
TOWN HIGHWAY SUPERINTENDENT
The Highway Superintendent of the Town of Tonawanda, New York.
UNDEVELOPED PLAT
A plat where 20% or more of the lots within the plat are unimproved unless existing conditions, such as poor drainage, have prevented their development.
ZONING LAW
The officially adopted Zoning Chapter of the Town of Tonawanda, together with any and all amendments.[1]
