[HISTORY: Adopted by the Board of Trustees of the Village of Nyack 8-9-1973 by L.L. No. 2-1973 (Ch. 56 of the 1972 Code). Amendments noted where applicable.]
The annual election in the Village of Nyack, New York, for the election of all elective Village offices shall hereafter be held and conducted in the fall of each year, coincident with the general fall elections held in accordance with and as provided by the federal election laws and the Election Law of the State of New York and any amendments thereto changing or varying the date of general fall elections.
A. 
The official year of the Village of Nyack, New York, shall begin at noon on the first day of January and end on the first day of each January thereafter, commencing on the first day of January 1975.
B. 
Terms of office.
(1) 
The term of office of the Mayor and each Trustee elected for a full term shall be two official years.
(2) 
All elective officers of the Village of Nyack shall serve until the end of their respective terms for which they were elected, except as hereinafter provided.
(3) 
The term of office of the two Trustees elected in March 1972, and expiring at noon on the first Monday of April 1974, shall be extended to noon on January 1, 1975.
(4) 
The term of office of the Mayor and the two Trustees elected in March 1973, and expiring at noon on the first Monday in April 1975, shall be extended to noon on January 1, 1976.
(5) 
There shall be no elections of the Village elective officers in the Village of Nyack until the fall elections to be held in the year 1974. Vacancies in elective Village offices shall be filled in accordance with the provisions of the Village Law.
(6) 
The term of office of the two Trustees to be elected under this chapter in November 1974, shall commence at noon on the first day of January 1975, and terminate at noon on the first day of January 1977.
(7) 
The term of office of the Mayor and the two Trustees to be elected under this chapter in November 1975, shall commence at noon on the first day of January 1976, and shall terminate at noon on the first day of January 1978.
(8) 
The term of office of the Police Justice of the Village of Nyack elected in March 1973, and expiring the first Monday of April 1975, shall be extended to noon January 1, 1976.
(9) 
The term of office of the Police Justice to be elected under this chapter in November 1975, shall commence at noon on the first Monday in January 1976, and shall terminate at noon on the first day of January 1980.
(10) 
The term of office of the Mayor and each Trustee hereafter elected pursuant to this chapter shall be for two official years commencing at noon on the first day of January following their respective elections and terminating at noon on the first day of the second January thereafter.
(11) 
The term of office of each Police Justice hereafter elected pursuant to this chapter shall be for four official years commencing at noon on the first day of January following his election and terminating at noon on the first day of the fourth January thereafter.
C. 
The annual meeting of the Board of Trustees shall be held at 8:00 p.m. on the first Monday of January of the year 1975, and each year thereafter, except that if said day shall fall upon the first of January in any year, then said Board of Trustees shall meet at 8:00 p.m. of the following day and such meeting shall be known as the "annual meeting of the Board of Trustees."
The proposition that this chapter be adopted shall be submitted to the electors of the Village of Nyack, New York, at a special election of the qualified electors to be held in said Village on the sixth day of November 1973, between the hours of 6:00 a.m. and 9:00 p.m. of said day, and this chapter shall become effective immediately if it is approved by a majority of the electors of the Village of Nyack who vote on the proposition at said election.
This chapter shall take effect and become operative only if approved by the affirmative vote of a majority of the qualified electors of the Village of Nyack voting upon the proposition as provided in the General Municipal Home Rule Law.[1]
