[HISTORY: Adopted by the Board of Trustees
of the Village of Lake Success 6-23-1965 as Chapter II of the Revised General
Ordinances. Amendments noted where applicable.]
The Board of Trustees of the Village of Lake
Success, County of Nassau, State of New York, pursuant to the provisions
of the Vehicle and Traffic Law of the State of New York, does hereby
enact the following chapter to regulate traffic and the use of vehicles
within the corporate limits of the Village of Lake Success.
As used in this chapter, the following terms
shall have the meanings indicated:
Every device in and upon, or which any person or property
is or may be transported or drawn upon a highway, except devices that
can be moved only by human power or used exclusively upon rails and
tracks.
A.
Parking of vehicles on the paved and traveled portions
of county and state highways within the Village is hereby forbidden.
B.
Parking of vehicles on paved areas of Village streets
is hereby forbidden, except that nothing herein contained shall be
construed so as to prevent the Police Department from granting temporary
permission, upon the request of a resident, and such permission shall
not be unreasonably withheld, for guest parking to be permitted in
front of and about such resident's premises if no driveway space is
available for the purpose, but in no event shall overnight parking
of vehicles be permitted on any street within the Village.
C.
No vehicle shall be parked on any street within the
Village within 30 feet of any street intersection.
D.
Vehicles parked on Village streets shall be parked
so that they shall not interfere with the ingress to or egress from
driveways in the vicinity.
E.
No vehicle shall be parked in such a way as to reduce
the usable width of any roadway available for moving traffic to less
than 15 feet.
F.
No vehicle shall enter upon or park on any property
owned, operated or maintained by the Village, unless lawfully authorized,
and then only in such manner and at such times and places as may be
specifically designated for such purposes by appropriate signs and
markings. No vehicle shall enter upon or park on any property within
the Village except through a designated entrance or curb cut approved
by the Village Planning Board.
G.
All vehicles, while standing, must have the right
side of vehicle parallel and no more than 12 inches from the curb
or curblines, except where otherwise specified.
H.
No vehicle shall be parked within 15 feet of a point
on the curb or curbline nearest to any fire hydrant.
I.
Parking of a vehicle on a plot zoned other than for
residence within the Village by any person who is visiting some other
property or plot within or without the Village, while said vehicle
is so parked, or is employed at another property or plot within or
without the Village, while said vehicle is so parked, or is engaged
in an occupation which requires such person's physical presence in
or on some other property or plot within or without the Village is
hereby forbidden.
J.
Parking or proceeding of a vehicle into an area of
pavement marked with diagonal hatch lines is hereby forbidden.

K.
Notwithstanding anything contained in this section
to the contrary, parking for no more than 30 minutes shall be permitted
on Village streets located within or between business districts (as
indicated on the Official Zoning Map) between the hours of 9:00 a.m.
and 5:00 p.m.

L.
Wherever a space shall be marked off on any street
or in any Village parking area for the parking of an individual vehicle,
every vehicle parked shall be parked within the lines bounding such
space. It shall be unlawful to park any vehicle across any line or
marking of a parking space or in such position that the vehicle shall
not be entirely within the area designated by such line or markings.

M.
No person shall stop, stand or park a vehicle in any
place so posted as restricted to handicapped parking unless he is
a holder of a valid special parking permit for the physically handicapped,
issued by a federal, state or local agency, or is the operator of
a specially registered vehicle for the physically handicapped, issued
by a federal, state or local agency, and in both cases, such vehicle
is being used at that time for the transportation of a physically
handicapped person.

When any vehicle is parked or abandoned or found
unattended on any highway or public place within the Village of Lake
Success during a snowstorm, flood, fire or other public emergency
affecting such highway or public place, or which vehicle constitutes
an obstruction to traffic, or where stopping, standing or parking
is prohibited, said vehicle may be removed by order of the Lake Success
Police Department and shall be removed and stored in such place and
by such commercial towing garage as may, from time to time, be designated
by the Board of Trustees. Such removal and storage shall be at the
expense of the owner of said vehicle, and such owner or person in
charge of the vehicle may redeem same upon payment to the designated
garage of the full cost of removal and storage, the rates for which
shall be uniform and shall be approved, from time to time, by the
Board of Trustees. The Lake Success Police Department shall endeavor
to ascertain the owner of each such vehicle removed from the Village
and shall notify him of the removal and disposition of his vehicle
and the amount of the charges which will be required to redeem same.
None of the foregoing provisions shall be considered to interfere
with the sale of unclaimed vehicles pursuant to other provisions of
law.
No person shall ride a bicycle or vehicle or
drive or ride a horse upon any street within the Village at a rate
of speed or in a manner to endanger the life, limb and/or property
of the public.
A.
No person shall operate a motor vehicle upon any of
the streets or highways of the Village of Lake Success at a rate of
speed in excess of 20 miles per hour, except that a rate of speed
not to exceed 30 miles per hour shall be permitted on Lakeville Road,
Route 25-D, also known as Little Neck - Old Westbury Road, and the
extension of Route 25-D, known as Lakeville Road, and on Marcus Avenue.
B.
Where the speed limit for vehicles is reduced as indicated
by signs posted on the said streets, highways or public places, it
shall be unlawful for any person to drive or operate any vehicle of
any type whatever between such signs at a rate of speed greater than
that stated on such signs. Such signs shall be as described in the
Schedule of Traffic Signs, Part 1.[1]
C.
Lakeville Road, Route 25-D, also known as Little Neck
- Old Westbury Road, Bates Road, Westminster Road, Old Field Lane
and Robbins Lane are hereby designated as main arteries of travel.
All vehicles approaching such main arteries of travel shall, before
entering the same, come to a full stop if indicated by a sign, unless
otherwise directed by a peace officer or signal.
A.
A "commercial vehicle" is a vehicle which is classified
by its license plate as commercial.
B.
No commercial vehicle as herein defined shall be operated
upon any street within the Village other than Lakeville Road, Horace
Harding Boundard, New Hyde Park Road, Bates Road, Marcus Avenue, Community
Drive, Northern Boulevard, the Long Island Expressway and the service
roads of said expressway, or parked on any street within the Village,
except for the purpose of making deliveries to or transporting materials
to or from houses or properties within the Village; for the purpose
of rendering a maintenance or other service in or for such houses
or properties; or for the purpose of installing, repairing or maintaining
streets, sidewalks, sewers, drains or utilities in, upon or over any
street or property within the Village, provided that in any such excepted
case, the commercial vehicle shall proceed from a street where commercial
vehicles are permitted to destination and return by the shortest available
route.

A.
Stop intersections. The intersections described in
the Schedule of Traffic Signs, Part 2,[2] are hereby designated as full-stop intersections, and
stop signs shall be erected as indicated. All vehicles shall comply
with said signs by coming to a full stop before proceeding.
B.
School crossing stops. All vehicles shall come to
a full stop and defer to pedestrians crossing at locations having
stop signs, as indicated by the Schedule of Traffic Signs, Part 3.
C.
Yield intersections. The intersections described in
the Schedule of Traffic Signs, Part 4, are hereby designated as yield
intersections, and yield signs erected there shall be complied with
by all vehicles.
D.
One-way streets. The streets or parts of streets described
in the Schedule of Traffic Signs, Part 5, are hereby designated as
one-way streets, and vehicles shall proceed only in the direction
indicated.
E.
Prohibited turns. No vehicle shall make a turn of
the kind designated as prohibited at any of the locations or at the
times specified, as described in the Schedule of Traffic Signs, Part
6.
F.
Keep right. All vehicles shall proceed only on the
right side of obstructions as indicated by "keep right" signs at locations
described in the Schedule of Traffic Signs, Part 7.
G.
Do not enter. No vehicle may enter into any street
or part of a street designated with a "do not enter" sign in locations
described in the Schedule of Traffic Signs, Part 8, and "dead end"
signs, also in Part 8, indicating there is no outlet for traffic which
enters the street.
H.
Do not block side road. No vehicle may stop or enter
an intersection where there is not sufficient space to proceed beyond
a side road, so as to block access to or egress from any side road.
Locations of signs saying "do not block side road" are described in
the Schedule of Traffic Signs, Part 9.
I.
Lanes must turn as indicated. All vehicles in lanes
marked with signs "left lane must turn left" or "right lane must turn
right" shall only proceed if they turn in the manner indicated at
the intersections described in the Schedule of Traffic Signs, Part
10.
J.
Do not pass. No vehicle shall pass another vehicle
going in the same direction on streets posted with "do not pass" signs,
as described in the Schedule of Traffic Signs, Part 11.
K.
No through trucks. No commercially licensed vehicle
may proceed continuously through a street, from one intersection to
the next, on streets so designated in the Schedule of Traffic Signs,
Part 12.

The Village of Lake Success shall install and
maintain traffic control devices, when and as required under the provisions
of this chapter, to make effective the provisions of this chapter,
and may install and maintain such additional traffic control devices
as the Board of Trustees may deem necessary to regulate, warn or guide
traffic under the Vehicle and Traffic Law of the State of New York,
subject to the provisions of §§ 1682 and 1684 of that
law.

The provisions of this chapter shall be implemented
by the adoption of regulations by the Board of Trustees or by the
Chief of Police, who is hereby authorized pursuant to § 1603
of the Vehicle and Traffic Law and § 20-2002 of the Village
Law to implement and adopt such regulations. Such regulations shall
be placed in the Schedule of Traffic Signs which shall be attached
to and form a part of this chapter,[1] and a violation of any regulation contained in said schedules
shall be deemed a violation of this chapter.

Any person violating any of the foregoing provisions
of this chapter shall be liable to a penalty not exceeding $1,500
for each and every offense.
