§ 203-1 Purpose.

The Town Board of the Town of Lewisboro recognizes that the trees and forests in the Town are an integral part of its natural ecosystem and, as such, play a vital role protecting the Town's valuable wetlands, steep slopes, hilltops and ridgelines. Therefore, it shall be the policy of the Town of Lewisboro to ensure that these natural resources are maintained, managed and preserved in a manner consistent with the Town development plan so as to minimize undesirable environmental impact and to protect the health, safety and welfare of present and future residents of the Town. As a means of promoting this policy, the following regulations are established.

§ 203-2 Regulations.

There shall be no cutting, clearing or removing of live, healthy trees over 10 inches in diameter on lands totaling five or more contiguous acres in the Town of Lewisboro under common ownership or control, except:
A. 
When the required application has been submitted to the Town Board and a permit issued.
B. 
Where desired by an individual homeowner for noncommercial purposes when incidental to the use and enjoyment of the homesite.
C. 
Where necessary and incidental to the improvement of lots and the construction of streets and related facilities in a subdivision plat site or plan granted final approval by the Planning Board and only in accordance with plans as approved by the Board showing the location and sizes of trees to be removed or cut.
D. 
In connection with the construction, reconstruction, enlargement, moving or structural alteration of a building or other structure, including construction and installation of site improvements related thereto, for which an application for a building permit shall have been approved by the Building Inspector.
E. 
As may be necessary to maintain Town, county, state or utility rights-of-way or to control forest fires.

§ 203-3 Permit requirements.

A. 
A permit shall be required from the Town Board for all tree cutting operations not exempted in § 203-2B through E above. The landowner shall file 10 copies of the permit application with the Town Clerk. This application shall contain the following:
(1) 
A summary of tree-cutting operations indicating:
(a) 
Total land area involved in cutting operations.
(b) 
The average number of trees to be cut per acre.
(c) 
The size range (diameter in inches) of trees to be cut.
(2) 
A United States Geological Survey topographical map on which are shown:
(a) 
Boundaries of property and area where cutting will occur.
(b) 
Access roads, skid roads and loading areas.
B. 
The Town Board may, as a condition of granting a permit:
(1) 
Regulate the days and hours of operations.
(2) 
Require a performance bond to insure compliance with this ordinance and other regulations of the Town of Lewisboro.
(3) 
Require that each tree to be cut or removed has been marked at two points, one low enough on the stump to be visible after removal of the tree.
(4) 
Require such other safeguards as appropriate to minimize the environmental impact of such cutting or removal operations.

§ 203-4 Penalties for offenses.

Any violation of this chapter shall be punishable by a fine of not less than $250 or in excess of $2,500 or imprisonment for a period not to exceed six months, or by both such fine and imprisonment. Each day's continued violation shall constitute a separate additional violation.
