This chapter is enacted to establish a procedure
whereby certain appointed public officers of the Village of Manlius
who are not otherwise afforded the due process provided in § 75
of the New York Civil Service Law may be afforded due process in the
event that the need arises for the appointing authority to pursue
disciplinary charges against such an officer on the grounds of incompetency
or misconduct.
A person holding a Village of Manlius appointed
public office in the noncompetitive or exempt class of the civil service
may be disciplined by the officer or body having the power of appointment
in accordance with the applicable provisions set forth in § 75
of the New York Civil Service Law, as it may be amended from time
to time.
The determination rendered by the appointing
authority pursuant to this chapter shall constitute a final determination
of the Village of Manlius and may be reviewed upon a petition timely
filed in accordance with the provisions of Article 78 of the New York
Civil Practice Law and Rules.
