It shall be unlawful for anyone except owners of residential property within the Incorporated Village of Massapequa Park to hold and conduct garage sales within the village, and lawful garage sales shall be subject to the following rules and regulations.
Within a calendar year, only three garage sales shall be allowed and permitted to be conducted and held, and each particular garage sale can last for a maximum of three consecutive days, but no more than two garage sales in any three-month period shall be permitted.
Before a garage sale can be held or conducted by an owner of residential property within the Village of Massapequa Park, a permit shall first be obtained from the village, and the sale permit must be conspicuously and publicly displayed on the house during the entire garage sale.
Only garage sales on residential property held or conducted by the lawful owner of same shall be permitted or allowed by the village.
The Village of Massapequa Park, through its Village Administrator, shall prescribe those rules and regulations for the holding of the said garage sale which shall protect and ensure the rights of the public attending said sale and those rights of the adjacent and adjoining property owners as it affects their quiet enjoyment and safety.

In the event that there is a violation of this Article and in the event that the property owner or his designated or lawful agent or representative is found guilty of the violation of this particular Article, they shall be fined for said violation up to the maximum fine allowed by law.
