Any homeowner in the Village of Massapequa Park or resident having lawful authority shall be allowed to install Belgian block curbs within the Incorporated Village of Massapequa Park as long as the same complies with the terms and conditions of the Nassau County Standard Specifications for the Construction of Bridges and Highways and subject to the written approval of the Superintendent of Public Works of Massapequa Park.
A. 
The homeowner or resident at all times, regardless of the reason, shall be solely responsible for the maintenance or care of said curb. In the event that there is any damage or repair which is required to the said curb, the homeowner or resident must immediately make repairs to same at his or her sole cost and expense.
B. 
In the event that the homeowner or resident is advised by the Village to make said repair, the homeowner or resident shall make the required repairs within 10 days after the notice from the Village at the homeowner's or resident's sole cost and expense.
A. 
In the event that the homeowner or resident fails to make said repairs in a timely fashion, the Village shall perform all the necessary work to remove the blocks and install a standard concrete curb and the homeowner shall be assessed for the full cost for the labor and materials for same and shall pay for said repairs to the Village promptly.
B. 
In the event that the homeowner or resident shall fail to pay for said cost and expense, then the same shall be imposed as a lien against the subject real property where the work was performed by the Village.
The Village shall not install or repair any curbs for any property within the Village with Belgian block curbs and, as stated above, shall install only standard concrete curbs in the event that it becomes necessary, even if the Belgian block curbs were originally installed legally and pursuant to specification by the homeowner or resident.
