The intent of the Golden Age District includes the provision of affordable owner-occupied housing for senior citizens in the Village of Massapequa Park, with said housing located on sites proximate to necessary facilities, services and transportation. Senior housing developments in the Golden Age District shall be developed by the private sector, subject to price guidelines for each residential unit.
A. 
This zoning district shall be restricted to and used only to provide affordable owner-occupied senior housing for individuals and couples with at least one partner 62 years of age or older.
B. 
No land shall be placed in this district unless and until it has been found suitable for senior citizen housing and has been approved by the Village Board after a public hearing. Said approval shall include an acceptable plan providing for maintenance, operation and administration of a senior complex.
C. 
The Village Board in its absolute discretion reserves the right to place any additional covenants and restrictions on the property developed pursuant to this section, including but not necessarily limited to the following items: age restrictions, owner selection criteria, eligible income criteria, sales and resale restrictions and any additional items deemed advisable by the Village Board to meet the intent of this article and ensure that said development positively impacts and promotes harmony with the land uses, zoning and nature of the surrounding community.
D. 
Priority for the owner-occupied housing for senior citizens shall be given first to the residents of the Incorporated Village of Massapequa Park. The second priority shall be given to the residents of the Massapequa Union Free School District No. 23. The third priority shall be given to residents of the Town of Oyster Bay.
No basement or cellar shall be occupied as living or sleeping quarters.
No building shall be greater than 2 1/2 stories high and in no event greater than 30 feet in height.
In a Golden Age District, no building shall be erected or altered on a lot having an area of no less than 2.5 acres.
The total building area shall not exceed 35% of the lot area.
The required front yard depth shall be a minimum of 25 feet.
In case of a corner lot, a front yard shall be required on each street.
There shall be two side yards, one on each side of property, each having a minimum width of at least 25 feet. Where a side yard(s) abuts a residential zone, the minimum width of side yard(s) shall be at least 35 feet with no portion of the building less than 25 feet from the property line. In addition, where there are two or more main buildings upon the plot, there shall be a minimum distance between buildings of 20 feet.
There shall be a rear yard, the depth of which shall be at least 25 feet, except where a rear yard abuts a residential district, in which case the minimum depth of a rear yard shall be at least 50 feet.
A. 
Chimneys, cornices, eaves, gutters or bay windows, projecting not more than 24 inches, and one-story open porches and/or terraces, not exceeding three feet in height, are hereby permitted as encroachments into the yard area.
B. 
Vestibules and one-story open porches and/or terraces, not exceeding three feet in height and projecting not more than 60 inches, are permitted.
A. 
All open parking facilities provided, pursuant to the requirements of this chapter, shall not be less than nine feet in width by 20 feet in depth, shall be individually identified by pavement marking and shall provide such space as is reasonably necessary for adequate ingress, egress and turning.
B. 
Parking space within 10 feet of any wall that contains windows, other than bathroom windows, with a sill height of less than eight feet above the level of said parking space, shall be prohibited.
C. 
Parking spaces may be provided in the side and rear yard setbacks when such side and rear setback abuts a residential zone; however, a suitable designed buffer, no less than 25 feet shall be provided to separate said parking from abutting residential property.
D. 
In a Golden Age District, 1.4 spaces are required for each residential unit.
In a Golden Age District, the maximum number of dwelling units shall not exceed 25 per acre or more than a proportionate number of dwelling units on any fractional part of an acre subject to the provisions of this article, and for the purpose of this section, a dwelling unit shall be such combination of rooms with provisions for living, cooking, sanitary and sleeping facilities arranged for the use of one family.
All parking areas and walkways shall be provided with suitable lighting so arranged as to direct light away from adjoining lots in any residence district and away from any public street.
No plot, piece or parcel of land within the Village of Massapequa Park shall be classified a Golden Age District until evidence, satisfactory to the Village Board, has been received that the system of sewage disposal for multiple dwelling and accessory buildings, authorized by this article, has received prior approval by the Village Engineer and the Nassau County Board of Health.
There shall be provided a usable indoor recreation area of a size deemed suitable by the Village Board to be commensurate with the number of units as designated pursuant to an approved site plan as required by § 345-62 contained herein.
In a Golden Age District, a fence, as defined in this chapter, not exceeding six feet in height may be erected on the rear lot line and such portions of the side lot lines as shall be lot lines enclosing the rear yard; and with respect to all other lot lines, such fence shall not exceed four feet in height, provided that if such fence shall be erected along any road or highway, the permitted height thereof shall be measured from the existing elevation of the center line of such highway opposite such fence, and provided further that such height, so measured, shall not exceed 2 1/2 feet to any point within a radius of 35 feet of the corner formed by any intersecting roads or highways. The provisions hereof shall also apply to hedges or other densely growing shrubbery.
The owner of the property and/or the builder under this chapter shall not be allowed to construct any building on top of any easement on the said property.
In a Golden Age District, no building or permit shall be issued unless a site plan is approved by the Board of Trustees of the Village of Massapequa Park pursuant to a public hearing. Said site plan shall include depictions, drawn to scale, of the following: front, side and rear elevation of each building, interior layout for each use, location of each building on the subject parcel, parking areas, including location and size of each parking space, means of ingress and egress for pedestrians and motor vehicles, exterior lighting, recreation facilities, fencing and landscaping, and shall conform in all instances to the site plan as submitted pursuant to the applicant's request of a change of zone.
