Fire prevention and building construction — See Ch. 121.
This chapter shall be known as the "Electrical Code of the Town of Salina."
Since there is danger to life and property inherent in the use of electrical
energy, this electrical chapter is enacted to regulate the installation, alteration
or maintenance of wiring for electrical light, heat or power and signal systems
operating on 50 volts or more in or on all real property within the Town of
Salina.

A.
All electrical installations heretofore mentioned shall be made in conformity with the requirements of the National Electrical Code, except where otherwise provided by this chapter. The requirements of the National Electrical Code shall be those known as the "National Fire Protection Association (NFPA), Pamphlet No. 70," as approved and adopted by the American Standards Association, or the "Residential Electrical Maintenance Code for One- and Two-Family Dwellings, NFPA Pamphlet No. 73." The specific editions shall be as designated by the Code Enforcement Officer, pursuant to Chapter 121, Fire Prevention and Building Construction, of this Code, which is on file in the offices of the Department of Planning and Development and the office of the Town Clerk.

A.
“Director” herein shall mean the Director of Planning
and Development of the Town of Salina.
B.
Upon the recommendation of electrical inspection agencies by
the Director, to the Town Board, to perform inspections of electrical wiring,
materials, apparatus or appliances in the Town of Salina pursuant to the provisions
contained herein, or upon its own initiative, the Town Board may authorize,
by resolution, an electrical inspection agency(s) to conduct electrical inspections
in the Town of Salina.
C.
All persons acting in a capacity as an electrical inspector shall
be certified by either the International Association of Electrical Inspectors
(Level III) or the International Codes Council as an electrical inspector,
which certification shall be filed with the Town and remain in full force
and effect at all times such inspector conducts inspections of electrical
installations in the Town of Salina. An authorized electrical inspection agency
shall file with the Director a copy of the certification for each electrical
inspector who shall operate on its behalf within the Town.
D.
No electrical inspector shall perform any electrical inspection
of any installation or premises in which said inspector or any person related
by blood to said inspector or a spouse has a pecuniary interest therein, or
which for any other reason would constitute a conflict of interest on said
inspector's part.
E.
During all periods when an electrical inspection agency is authorized
to inspect within the Town, it shall maintain comprehensive liability insurance,
naming the Town of Salina as an additional insured in such form and with such
limits as established from time to time by resolution of the Town Board. A
current certificate of insurance in form approved by the Town shall be on
file with the Town Clerk and the Director.
F.
The Town Board may at any time, upon its own initiative or upon
the recommendation of the Director, terminate the authority of any authorized
electrical inspection agency or electrical inspector to conduct electrical
inspections hereunder and the Director may upon the noncompliance by such
agency or inspector with the provisions herein or upon the inconsistent application
of the standards for electrical installations to different premises by either,
suspend the approval of any such agency or inspector upon notice to the Town
Board, which suspension shall continue until further action by the Town Board.
G.
Each authorized electrical inspection agency is hereby authorized
to conduct inspections and reinspection of electrical installations in buildings
and premises within the Town of Salina, for compliance with the Electrical
Code, and to approve or disapprove the same, and in no event shall the cost
or expense of such inspections and/or reinspection be a charge to the Town
of Salina, and all costs for inspections or reinspection required by this
section shall be paid by the applicant. Each certified inspector of an authorized
electrical inspection agency is hereby designated and authorized to serve
as an electrical inspector for the Town of Salina.
H.
No electrical inspector or electrical inspection agency authorized
hereunder shall inspect and approve or issue a certificate of compliance for
any property for which there has been issued a notice of noncompliance by
another electrical inspector or electrical inspection agency authorized hereunder.
A.
It shall be the duty of the inspector to report, in writing,
to the Code Enforcement Officer, whose duty is shall be to enforce all the
provisions of this chapter, all violations or deviations from or omissions
of the Electrical Code or the electrical provisions of the New York State
Uniform Fire Prevention and Building Code,[1] as referred to in this chapter, insofar as any of the same apply
to electrical wiring and installations in the Town of Salina, upon written
request of the Code Enforcement Officer.
B.
The inspector is authorized to make inspections and reinspection
of electrical wiring, installations, devices, appliances and equipment in
and on properties within the Town of Salina where necessary for the protection
of life and property.
C.
In the event of an emergency, it is the duty of the inspector
to make electrical inspections upon the oral request of any official of the
Town of Salina.
D.
It shall be the duty of the inspector to furnish written
reports to the proper officials of the Town of Salina and owners and/or lessees
of property where defective electrical installations and equipment are found
upon inspection. He shall also authorize the issuance of a certificate of
compliance when electrical installations and equipment are in conformity with
this chapter and the Electrical Code. A copy of such certificate shall be
sent to the Town of Salina to the attention of the Code Enforcement Officer.

It shall be a violation of this chapter for any person, firm or corporation
to install or cause to be installed or to alter electrical wiring for light,
heat or power in or on properties in the Town of Salina until an application
for inspection has been filed with an electrical inspection agency approved
hereunder. It shall be a violation of this chapter for a person, firm or corporation
to connect or cause to be connected electrical wiring in or on properties
for light, heat or power to any source of electrical energy supply prior to
the issuance of a temporary certificate or a certificate of compliance by
an electrical inspection agency approved hereunder.

The provisions of this chapter shall not apply to the electrical installations
of mines, ships, railway cars, automotive equipment or the installations or
equipment employed by a railway, electrical or communications utility in the
exercise of its functions as a utility and located outdoors or in buildings
used exclusively for that purpose. This chapter shall not apply to any work
involved in the manufacture, assembly, test or repair of electrical machinery,
apparatus, materials and equipment by a person, firm or corporation engaged
in electrical manufacturing as their principal business. It shall not apply
to any building which is owned or leased in its entirety by the government
of the United States or the State of New York.

This chapter shall not be construed to relieve from or lessen the responsibility
of any person owning, operating, controlling or installing any electrical
wiring, devices, appliances or equipment for loss of life or damage to persons
or property caused by any defect therein, nor shall the Town of Salina or
the authorized electrical inspection agency, or any individual electrical
inspector, be deemed to have assumed any such liability by reason of any inspection
made pursuant to this chapter.
