The Board of Trustees of the Incorporated Village of Sands Point (hereinafter
the "Board") hereby finds that it is beneficial to the Village of Sands Point
(hereinafter the "village") and its residents to establish and maintain the
newly acquired municipal recreational facility known as the "Village Club
of Sands Point" as a self-supporting improvement in accordance with Article
13 of the Village Law of the State of New York. The Board further finds it
to be fair and equitable and in the best interest of the village and its residents
to limit the use of the golf course and tennis facilities to village residents
and, if necessary, nonresidents who pay an annual membership fee for the use
and enjoyment of such facilities. The number of nonresidents that may be issued
membership for the use of such facilities shall be limited to that which the
self-supporting improvement may efficiently and economically serve or accommodate
in excess of village residents and as shall be determined. It is, therefore,
the intent of the Board of Trustees, in enacting this chapter, to establish
and maintain the Village Club of Sands Point as a self-supporting improvement
in accordance with Article 13 of the Village Law of the State of New York,
to limit and regulate the use thereof and to authorize the imposition of an
annual membership fee structure and other charges relating to or arising from
the use of the golf course and tennis facilities.
The Village Club of Sands Point, a village-owned facility acquired for
general municipal purposes, located on village property located at Middle
Neck Road, Sands Point, New York, is hereby established as a self-supporting
improvement pursuant to the provisions of Article 13 of the Village Law of
the State of New York.

The use of the golf course and tennis facilities provided
by the Village Club of Sands Point shall be limited to village residents and
a select number of nonresidents who pay the annual membership fees and their
authorized guests.

The use of all recreational facilities provided by the Village Club of Sands Point, other than the golf and tennis facilities, shall be limited to village residents, as regulated by § 33-5 hereof, and to nonresidents who pay the annual membership fees established by the Board of Trustees for such facilities.

For purposes of this chapter, a resident shall be a person
or a member of the household of a person who either:

A child of an eligible owner or lessee shall be presumed
to be a nonresident if he has a place of residence outside of the village,
except one which is maintained by reason of his full-time attendance at a
recognized educational institution or his membership in the Armed Forces of
the United States.

Rent or rental, as used in this section, must include
the following: a taking over of the premises by the renter and vacating by
the owner and his family and the payment of a fixed amount of rent money for
a definite period of time of at least one year. Presentation of a written
lease evidencing such tenancy shall be required.

For purposes of this chapter only, a household unit shall
consist of two adults, neither of whom shall be an employee of the resident,
and their children, which children reside in the dwelling and are under the
age of 26.

Proof of residency shall be required from the person
applying for resident privileges at the Village Club of Sands Point and shall
be verified by the Village Clerk.
C.Â
A property owner renting his home in the village and
not actually residing in the Village of Sands Point shall not be entitled
to resident use privileges at the Village Club of Sands Point during the period
of such rental, but may be given preference as a nonresident.
D.Â
A club identification card shall be required for access
to the Village Club of Sands Point. A club identification card shall be issued,
at no additional charge beyond the annual membership fee, to all golf and
tennis members. Nonmember village residents may obtain a club
identification card upon payment of a charge as established by the Board of
Trustees.
E.Â
Any person who has been denied resident use privileges
at the Village Club of Sands Point may appeal such denial to the Board of
Trustees, whose decision shall be final.
The categories of membership, annual membership fees, guest privileges
and all other charges relative to the use of the recreational facilities at
the Village Club of Sands Point shall be established and revised, from time
to time, by resolution of the Board of Trustees after public hearing held
on notice.
