The Village Board of the Village of Sylvan Beach, in order to promote the general health and welfare and in the exercise of its police powers to promote the same, after due consideration and having heard all opposed and in favor, does hereby find that the general health, welfare and interest of the public will be protected and promoted by the adoption of the following Article.
As used in this Article, the following terms shall have the meanings indicated:
APPEARANCE TICKET
That instrument defined in § 1.20, Subdivision 26, of the Criminal Procedure Law as a written notice issued by a public servant, more fully defined in § 150.10, requiring a person to appear before a local criminal court in connection with an accusatory instrument to be filed against him therein.
CODES ENFORCEMENT OFFICER
That individual duly appointed by the Mayor of the Village of Sylvan Beach, and approved by the Village Board, to the position of Codes Enforcement Officer of the village.
In addition to any duties imposed upon him by his office, status, law, and/or regulation, the Codes Enforcement Officer of the Village of Sylvan Beach and/or his duly designated employees and/or assistants is hereby authorized to issue and serve upon a person an appearance ticket, pursuant to Article 150 of the Criminal Procedure Law, when he has reasonable cause to believe that such person has committed a violation of any provision of law, rule or regulation which such Codes Enforcement Officer is authorized to investigate and enforce.
The Codes Enforcement Officer and/or his duly designated employees and/or assistants who has issued and served an appearance ticket must, at or before the time such appearance ticket is returnable, file or cause to be filed with the court in which it is returnable an information or a simplified information or a misdemeanor complaint charging the person named in such appearance ticket with the offense specified therein. Nothing herein contained shall authorize the use of a simplified information when not authorized by law.

The Codes Enforcement Officers of the Village of Sylvan Beach are hereby authorized to issue and serve appearance tickets in connection with the performance of their duties, including the issuance of appearance tickets for vehicular parking violations.
