GENERAL REFERENCES
Peddling and soliciting — See Ch. 88.
A. 
Merchants having fixed places of business within the Village of Sylvan Beach will be allowed to display, out of doors, during regular operating hours, merchandise and goods for sale, rent or lease. Said items shall be removed to the inside of an enclosed building at all times the business is not open to the public and/or from 1:00 a.m. each night until 8:00 a.m. the next day. All such displays will be erected so as not to interfere with normal pedestrian and motor vehicle traffic.
B. 
Merchants desiring to store merchandise and/or goods out of doors may do so by obtaining a permit from the Village of Sylvan Beach Clerk to erect an outdoor warehouse, approved by the Village Board. All such outdoor warehouses shall be surrounded by an enclosure permanently fixed to the ground. Said enclosure shall be vision proof of a height not less than six feet nor more than 12 feet, shall be painted and kept in good repair and shall be located on a lot in the same manner as is required of a building in Chapter 136, Zoning.
C. 
Merchants dealing in goods normally used out of doors may apply to the Village of Sylvan Beach Clerk for a permit to display 24 hours a day said goods out of doors, so long as they are not easily removed to the inside of a building or to an enclosed outdoor warehouse.

A. 
Short-term displays and/or sale, rent or lease of any goods or merchandise shall hereafter only be conducted between the hours of 9:00 a.m. and 7:00 p.m. by residents at their residence.
B. 
No outdoor display and/or sale, rent or lease of any goods or merchandise shall be permitted by any nonresident, unless said display and/or sale, rent or lease of any goods or merchandise is attached to or conducted from a building, as defined in § 136-4 of the Zoning Law, and unless said outdoor display and/or sale, rent or lease of any goods or merchandise is conducted within a district which allows same.
C. 
All displays and/or sale, rent or lease of any goods or merchandise shall be removed from the resident's yard and removed to an enclosed building after 7:00 p.m.
D. 
Residents, businesses, corporations, churches, schools, fraternal organizations, fire departments and other groups desiring to display and/or sell, rent or lease any goods or merchandise may apply to the Village of Sylvan Beach for a permit to do so and, having shown good cause for said permit, may be so licensed for a period of up to three days.
E. 
All residents, businesses, corporations, churches, schools, fraternal organizations, fire departments and any other groups displaying and/or selling, renting or leasing any goods or merchandise must provide adequate off-street parking and must comply in all respects herewith.

A. 
A fee of $25 shall be collected equally from each permit holder.
B. 
The Village Board may by resolution increase or decrease the permit fee.
C. 
The Village Board may upon resolution waive the permit fee for any village-sponsored lawn sales, the dates for which may be announced annually by the Village Board.
All sections of this chapter shall also apply to nonprofit organizations, except that the height restrictions, screening provisions, permits, fees and time limits are waived.

Any person violating any of the provisions of this chapter shall be guilty of a violation and, upon conviction thereof, shall be punishable by a fine not exceeding $250 for each offense or imprisonment not exceeding 15 days, or both such fine and imprisonment.
