[HISTORY: Adopted by the Board of Trustees of the Village of Tivoli 5-11-1998 by L.L. No. 1-1998. Amendments noted where applicable.]
A. 
Dealing in junk, used auto parts and used materials in the Village of Tivoli without having first procured a license from the Village Clerk, as hereinafter provided, is hereby prohibited.
B. 
No dealer in junk, used auto parts and/or other used materials shall carry on such business other than on the premises designated in the license.
No such dealer shall purchase any material from a minor, knowing or believing such person to be a minor. No purchases shall be made between the time of the setting of the sun and 7:00 a.m.
No license shall be granted to a person or to a partnership, corporation or association, any member of which has within the last five years been convicted of a felony or convicted of having received stolen goods.
Every dealer licensed under this chapter shall keep a daily record, in a bound book, written in ink or in indelible pencil, of all the articles purchased and the price paid, the name, residence, age, occupation of the person from whom purchased, the name of the employer of such person and the date and the hour of purchase. Such record shall be available at all reasonable times to law enforcement officers and to Justices. No entry in the record book shall be altered, changed or obliterated.
When goods advertised in the designated official newspaper of this Village as being lost or stolen shall have come into the possession of a dealer licensed under this chapter, such dealer shall notify the Village Clerk, in writing, of his possession of such goods and shall give the name and address of the person from whom such goods were obtained.
On and after January 1, 1965, the wrecking, shearing and salvaging operations of a dealer licensed under this chapter shall be conducted only within a building on premises where the entire lot is enclosed with a solid fence at least eight feet high. Such building shall not be erected closer than 50 feet to any highway boundary line and not closer than 25 feet to any other property boundary line. The areas between such building and highway or other boundary line shall not be used for the storage of junk, motor vehicles, parts of motor vehicles or used materials.
On and after the effective date of this chapter, no burning will be conducted upon the licensed premises.
An annual license fee as set forth from time to time by resolution of the Board of Trustees[1] is hereby established for dealers in junk, used auto parts and used materials in the Village of Tivoli. Said license shall be issued, subject to the following regulations:
A. 
The application for a license shall be made under oath and shall contain such information as the Village Board, by resolution, may require.
B. 
No license shall be issued by the Village Clerk unless it affirmatively appears from the license application submitted, pursuant to resolution of the Village Board, that such dealing in junk, used auto parts and used materials shall also meet the requirements and provisions of any applicable laws, ordinances or regulations as may be in effect at the time of application for a license.

Any person violating any of the provisions of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, be punishable by a fine not to exceed $1,000 or imprisonment not to exceed one year for each offense or by both such fine and imprisonment. In addition, a civil penalty of $25 per day for each day of violation of said chapter is hereby imposed.
