§ 184-1 Program established; general provisions.

A. 
There is hereby established a program for the separation/preparation for collection and for collection of waste materials.
B. 
This program applies to all residents served by the village garbage collection system.
C. 
The village will continue to provide curbside pickup on Monday and Thursday for both recyclable and nonrecyclable waste material.
D. 
The village shall have no obligation to pick up and remove any waste material not prepared for collection in accordance with this article.
E. 
The village shall have no obligation to pick up and remove any waste material which was not used in the residence or business placing such waste material at curbside for pickup.
F. 
All waste material shall be separated, prepared for collection and collected in accordance with § 184-5 of this article.
G. 
A village recycling center shall be maintained where residents may bring their recyclables if preferred to curbside pickup and for deposit of items not included in curbside pickup, such as car and household batteries and return deposit bottles and cans.

§ 184-2 Preparation of waste material for collection.

A. 
All waste material shall be separated into the following six categories:
(1) 
Clear glass (recyclable).
(2) 
Green glass (recyclable).
(3) 
Brown glass (recyclable).
(4) 
Newspapers (recyclable).
(5) 
Plastic containers (recyclable).
(6) 
Garbage and rubbish (nonrecyclable).
B. 
All recyclable containers shall be empty, rinsed and clean, except for automotive products. Automotive product containers shall not be rinsed or have caps removed and contents shall have been completely used up.
C. 
Newspapers shall be tied securely in bundles or packed tightly in brown bags. No glossy inserts, staples, magazines, window envelopes or cardboard shall be placed with newspapers.
D. 
No light bulbs, window glass, crockery, china or decorative glass shall be placed with glass containers. Glass containers shall be unbroken.
E. 
Only high-density polyethylene (HDPE) plastic containers which contained the following products shall be recyclable: milk, juice, water, motor oil, windshield washer fluid, antifreeze, bleach, liquid soap, detergent, shampoo, conditioner. No plastic toys, clear plastic, squeezable plastic, storage or takeout containers, cottage cheese, yogurt, sour cream containers, plastic bags or return deposit bottles shall be placed with plastic containers. Plastic containers shall be flattened.
F. 
Garbage and rubbish shall be contained in a special disposable paper bag which residents are required to use.
G. 
Residents shall provide containers for all recyclables.
H. 
No grass clippings, leaves, brush or other yard organics, construction and demolition debris, large household furnishings, large appliances, tires or hazardous waste shall be placed at curbside for regular collection.
I. 
No container shall weigh more than 50 pounds, including contents.
J. 
Large appliances, such as refrigerators and stoves, may be picked up for a fee as set forth, from time to time, by resolution of the Board of Trustees,[1] upon special arrangement with the Village Clerk.[2]

K. 
The Board of Trustees from time to time may determine that certain materials shall be added or deleted from the list of recyclables based on availability of markets.

§ 184-3 Collection.

A. 
Garbage and rubbish shall be picked up on Monday only.
B. 
Recyclables shall be picked up on Thursday only.
C. 
All waste material to be picked up shall be at the curb no later than 7:30 a.m. on the day of collection, and no material shall be placed at the curb before the day of collection.
D. 
Empty containers shall be removed from the curbside before the end of the day on which collection is made.

§ 184-4 Ownership of recyclables placed for collection.

A. 
Any recyclable material placed at the curb on collection day or in the Recycling Center becomes the property of the village and shall not be picked up by any person who does not have written permission to do so from the Village Board of Trustees.
B. 
The person responsible for initially placing waste material at curbside shall remove those materials where collection has been refused because materials or preparation of materials has not been in accordance with this article.
C. 
Nothing herein shall prevent any person from making arrangements for the private collection of recyclables.

§ 184-5 Special bags for collection.

A. 
Garbage and rubbish shall be picked up only if contained in a special disposable paper bag available from the village.
B. 
The bag holds 30 gallons and may be placed indoors or outdoors, wherever residents now keep their garbage containers. it is 16 inches by 12 inches by 35 inches with a square bottom and constructed of two-ply, fifty-pound natural wet strength Kraft Paper with waterproof adhesive. It is self-standing, weather resistant, and will hold moist or dry garbage. It is biodegradable and recyclable.
C. 
Residents shall purchase the bag for a fee as set forth, from time to time, by resolution of the Board of Trustees.[1]

D. 
The bag shall be sold by the Village Clerk during regular office hours.
E. 
A minimum of four bags shall be purchased at one time.
F. 
The top of the bag shall be folded closed before the bag is placed at curbside, and it shall contain no more than 50 pounds.

§ 184-6 Penalties for offenses.

A. 
The burning of garbage and rubbish is prohibited by New York State Department of Environmental Conservation Law § 215.
B. 
In addition to any penalty contained in any other provision of law, any person, firm or corporation who shall violate any of the provisions of this article shall, upon conviction, be punishable by a fine of not more than $250 or imprisonment for not more than 15 days, or both. Each day of continuance of an offense shall be considered a separate offense.[1]

§ 184-7 Distribution of copies.

A. 
The Board of Trustees shall cause a copy of this article to be distributed to each household on the village garbage collection system.
B. 
The Village Clerk shall keep copies in the Village Office for distribution to new residents and others who may request a copy.
