Whenever a violation of this chapter occurs,
any person may file a complaint in regard thereto. All such complaints
must be in writing and shall be filed with the Building Inspector,
who shall properly record such complaint and immediately investigate
and report thereon.
Any owner, lessee, contractor, agent or other
person who knowingly uses or maintains or causes to be used or maintained
any building, structure or premises, or any part thereof, in the Village
for any purpose other than the uses permitted therefor in this chapter,
or who erects, enlarges, demolishes, alters or maintains, or knowingly
causes to be erected, enlarged, altered, demolished or maintained,
any building or any part thereof in the Village except in conformity
with the provisions of this chapter, or who knowingly uses or maintains
or causes to be used or maintained any building altered other than
in conformity with the provisions of this chapter, or who in any manner
knowingly violates or causes to be violated any provision of this
chapter, shall, upon conviction, be subject to a fine of not more
than $250 for each such violation. Each and every day such violation
continues may be deemed a separate and distinct violation.
If any said person fails to abate any such violation
of this chapter within a reasonable time after written notice has
been served personally upon said person, or has been sent to said
person by registered mail at said person's home or business address,
said person shall be subject to a civil penalty of $250 for each and
every day said violation continues, recoverable by suit brought by
the Village.
A.
Whenever the Board of Trustees is satisfied that any
building or structure or any portion thereof permitted or forbidden
is being used, constructed, altered, repaired or demolished in violation
of or not in compliance with any of the provisions or requirements
of this chapter, it may, in its discretion, through the Attorney of
the Village, institute any appropriate action or proceeding at law
or in equity to restrain, correct or remove such violation or the
execution of any work thereon, or to restrain or correct the use,
erection or alteration of or to require the removal of or to prevent
the occupancy or use of the building or structure erected, constructed
or altered in violation of or not in compliance with any of the provisions
of this chapter.
B.
The Attorney for the Village is authorized, subject
to the approval of the Board of Trustees, to institute all actions
and proceedings, either legal or equitable, that may be appropriate
or necessary for the enforcement of the provisions of this chapter.
C.
The remedies provided herein shall be cumulative and
shall be in addition to any other remedies provided by law.
