It shall be unlawful for any firm, corporation, company or person to have, possess, keep, store or use any explosives, without obtaining a permit from the Clerk of the Village of Valley Stream, except such articles as defined by the Interstate Commerce Commission regulations for the transportation of explosives or other dangerous articles, and unless these explosives are stored, used or transported in conformity with the regulations of the State of New York and the Public Safety Bureau of Nassau County Police Department.
No firm, corporation, company or person shall sell, expose for sale or give away any caps, percussion caps, fuse or electric blasting caps, dynamite or any other explosive materials of any description without first obtaining a permit from the Clerk of the Village of Valley Stream.
No firm, corporation, company or person shall discharge any firearms, rockets, gunpowder, firecrackers, torpedoes, blasting caps, dynamite or other explosives within the Village of Valley Stream except as provided for under § 1894-A of the Penal Law of the State of New York.[1]

No firm, corporation, company or person shall operate or maintain a shooting gallery or range without obtaining a permit from the Clerk of the Village of Valley Stream.
It shall be lawful to conduct or participate in a public entertainment consisting of a display of fireworks, to witness which the public is invited or an admission fee is charged, in the incorporated area of the Village of Valley Stream on the first day of the week after 2:00 p.m.
All permits under this chapter shall be approved by the Board of Trustees of the Incorporated Village of Valley Stream. No application shall be considered without first obtaining the recommendations of the Bureau of Public Safety, Nassau County Police Department, in writing, which shall be attached to the application before being acted upon by the Village Board.
All permits shall expire one year from the date they are issued, unless sooner revoked by the issuing authority.
There shall be a fee of $10 for the issuance of a permit hereunder by the Village Clerk; provided, however, that there shall be no fee for the issuance of a permit to a school or educational institution approved by the Board of Regents of the State of New York or to an individual to keep, store or possess explosives solely for the purpose of reloading small-arms ammunition.

Any person or persons, firm, company, association, corporation or business of any kind violating this chapter shall be guilty of a misdemeanor, which shall be punishable by a fine of not more than $3,000 and/or 15 days in jail for each violation, or by both such fine and imprisonment.
This chapter shall be known and may be cited as the "Explosive Ordinance of the Village of Valley Stream" or as "Ordinance No. 96 of the Village of Valley Stream."
This chapter shall take effect immediately.
