A.
It shall be unlawful for the owner, operator or other
custodian of any motor vehicle to park, abandon or to leave unattended
such motor vehicle or to cause or allow the same to be parked, abandoned
or left unattended, within the right-of-way of any road, street, highway
or other thoroughfare within the Township of Lower Makefield, during
the period commencing two hours after the commencement of snowfall
and expiring 48 hours after the termination of such snowfall.
B.
No parking shall be permitted where an official sign
prohibits parking of motor vehicles.
C.
No parking shall be permitted in any fire zone, officially
designated by signs or pavement markings, in any shopping center,
school or other area of Lower Makefield Township.
D.
No parking shall be permitted in any handicapped parking
area, officially designated by signs or pavement markings, in any
shopping center, school, apartment complex or other area of Lower
Makefield Township.
Except when directed to proceed by a police
officer, every driver of a vehicle approaching a stop sign shall stop
at a clearly marked stop line or, if none, before entering a crosswalk
on the near side of the intersection or, if none, at a point nearest
the intersecting roadway where the driver has a view of approaching
traffic on the intersecting roadway before entering. After stopping,
the driver of a vehicle shall yield the right-of-way to any pedestrian
in a crosswalk or to any vehicle in the intersection or approaching
so closely as to constitute a hazard during the time the driver is
moving across or within the intersection. The following are hereby
designated as stop intersection within the Township:

Definitions. For the purposes of this section, the
following words and phrases shall be defined as indicated:
Two or more vehicles physically interconnected in tandem.
Any vehicle used or designed to be used for commercial purposes
as follows:
The maximum gross weight at which a vehicle or combination
is registered in this commonwealth or any other commonwealth or state
to operate upon a highway.
A vehicle designed to be towed by a motor vehicle, used or
maintained primarily for the transportation of property.
A motor vehicle designed, used or maintained primarily for
the transportation of property.
A motor vehicle designed and used primarily for drawing other
vehicles and not so constructed as to carry a load other than a part
of the weight of the vehicle and load so drawn.
B.
No person shall operate any commercial vehicle as defined in Subsection A over any residential street within the Township, except for the purpose of transporting merchandise or persons loaded or to be delivered in the Township. In any event, the operator of such vehicle shall use only state highways, except for those Township streets which must be traveled in order to arrive at the delivery or loading destination.
C.
Trucks are restricted on the following roads:
D.
Any other vehicle used for a municipal purpose.
E.
Parking restrictions.
(1)
The parking of any commercial vehicles is prohibited
on any street within the Township of Lower Makefield except within
areas zoned for industrial.
(2)
Official "no parking of commercial vehicles" signs
shall be erected and maintained along the streets within the Township
of Lower Makefield so as to give notice of such provisions of this
chapter, all of which shall be done in accordance with Section 6122
of the Pennsylvania Motor Vehicle Code.[1]

(3)
The foregoing regulations of this chapter shall not
apply to emergency vehicles or commercial vehicles temporarily parked
for emergency purposes, including fire trucks, ambulances, fuel delivery
trucks, tow trucks or other emergency equipment or to vehicles being
used for agricultural purposes when the vehicles are located on the
premises where the agricultural activity is taking place or vehicles
in the process of delivering a product, material or service.
A.
No person shall operate any motor vehicle, except
those vehicles which are powered by human power, upon any lands or
areas within Lower Makefield Township that have been designated open
to the public except in areas specifically designated for motor vehicle
parking or access.
B.
Use of bike paths. The use of any motorized vehicles
on designated bike paths is strictly forbidden.
C.
The terms and conditions of this § 190-8 shall not apply to any person who is expressly designated and authorized by the Township, or its authorized officials, representatives, agents or contractors, to undertake, and who is actively engaged in and carrying out, any actions, activities, practices, duties, responsibilities or other obligations related to or in connection with a deer management program, as such term is defined in Chapter 141 hereof, upon any lands or areas within Lower Makefield Township that have been designated open to the public or on lands owned, leased or controlled by Lower Makefield Township, whether in the park system or otherwise:

(1)
If
such person submits a formal, written request for the operation of
a motor vehicle upon any lands or areas within Lower Makefield Township
that have been designated open to the public at least three business
days prior to such proposed operation; and
(2)
If,
based upon the attendant circumstances, such operation of a motor
vehicle is determined by the Township to be unavoidable or reasonable,
necessary and prudent in order to advance a deer management program;
(3)
If
the Township shall provide its approval of such request to the applicant
in writing, which approval may also include such other policies, procedures,
regulations or rules as the Township may, in its discretion, impose
on such operation; and
A.
Intersections. On any corner lot, no wall, fence,
sign or other structure shall be erected or altered and no hedges,
trees, shrubs or other growth shall be maintained which may cause
danger to traffic on a street or public road by obscuring the view.
A clear sight triangle of 25 feet, measured along the right-of-way
lines of intersecting streets, shall be maintained, within which such
structures or planting shall be limited to a height of not more than
1.5 feet above the street grade.
B.
Driveways and private accessways. At each point where
a private accessway or driveway intersects a public street or road,
a clear sight triangle of 15 feet, measured from the point of intersection
of the street and the accessway, shall be maintained within which
vegetation and other visual obstructions shall be limited to a height
of not more than 1.5 feet above street level.
C.
It shall be the property owner's responsibility to
maintain the sight triangle. The Township shall have the right to
declare an obstructed sight triangle to be a safety hazard and to
clear the same, at the owner's expense, should the owner fail to do
so after proper notice.
A.
Purpose. The purpose of this section is to provide
rules and regulations governing the use of pedalcycles in Lower Makefield
Township. It is enacted with the intention of improving the safety
and convenience of pedalcycle transportation in the Township.

Definitions. As used in this section, the following
terms shall have the meanings indicated:
A lane designated and delineated by signs, markings and striping
or a barrier for the preferential or exclusive use by pedalcycles.
It may be located on the paved surface such as the right side of a
shoulder or between the parking lane and motor vehicle travel lane
or between the motor vehicle travel lane and the curb.
A special facility for the exclusive use of pedalcycles,
having a separate surface which is not contiguous with adjacent motor
vehicle facilities.
A roadway which is officially designated and marked as a
route for pedalcycles but which is open to motor vehicle traffic and
upon which no bike lane is designated.
A general term to designate all facilities that explicitly
provide for pedalcycle travel.
A vehicle propelled solely by human-powered pedals.
That portion of a highway, including shoulders, for vehicular
travel, including the entire area within the right-of-way.
C.
Applicability of traffic laws to pedalcycles.
(1)
General rule. Every person riding a pedalcycle upon
a roadway shall be granted all the rights and shall be subject to
all of the duties applicable to the driver of a vehicle, except as
to special provisions as specified below and except as to those provisions
of the Vehicle Code of Pennsylvania[1] which by their nature can have no application.

D.
Penalty for violations of this section. Any person
violating any provision of this section is guilty of a summary offense
and shall, upon conviction, be sentenced to pay a fine of $10, plus
costs of prosecution.
E.
Responsibility of parent or guardian. The parent of
any child and the guardian of any ward shall not authorize or knowingly
permit the child or ward to violate any of the provisions of this
section.
F.
Riding on pedalcycle.
(1)
Use of seat by operator. A person propelling a pedalcycle
shall not ride other than upon or astride a permanent and regular
seat attached to the pedalcycle.
(2)
Number of riders. No pedalcycle shall be used to carry
more persons at one time than the number for which the pedalcycle
was designed and equipped, except that an adult rider may carry a
child securely attached to the rider in a backpack or sling.
G.
Riding on roadways and bikeways.
(1)
General rule. Except as provided in Subsection G(2), every person operating a pedalcycle upon a roadway shall ride as near to the right side of the roadway as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction.
(2)
One-way highways. Any person operating a bicycle upon
a roadway of a highway, which highway carries traffic in one direction
only and has two or more marked traffic lanes, may ride as near the
left-hand curb or edge of the roadway as practicable, exercising due
care when passing a standing vehicle or one proceeding in the same
direction.
(3)
Limitation on riding abreast. Persons riding pedalcycles
upon a roadway shall not ride more than two abreast except on paths
or parts of roadways set aside for the exclusive use of pedalcycles.
(4)
Use of available bike lane. Whenever a lane has been
provided as part of a highway, pedalcycle riders shall use the lane
and shall not use any other part of the highway. This subsection does
not apply when use of the bike lane is not possible, safe or reasonable.
H.
Articles carried by operator. No person operating
a pedalcycle shall carry any package, bundle or article which prevents
the driver from keeping at least one hand upon the handlebars.
I.
Lamps and other equipment on pedalcycles.
(1)
Lamps and reflectors. Every pedalcycle when in use
between sunset and sunrise shall be equipped on the front with a lamp
which emits a white light visible from a distance of at least 500
feet to the front and with a red reflector on the rear of a type approved
by the Pennsylvania Department of Transportation which shall be visible
from all distances from 100 feet to 600 feet to the rear and with
an amber reflector on each side. A lamp emitting a red light visible
from a distance of 500 feet to the rear may be used in addition to
the red reflector. A lamp worn by the operator of a pedalcycle shall
comply with the requirements of this subsection if the lamp can be
seen at the distance specified.
(2)
Audible signal devices. A pedalcycle may be equipped
with a device capable of giving a signal audible for a distance of
at least 100 feet except that a pedalcycle shall not be equipped with
nor shall any person use any siren.
(3)
Brakes. Every pedalcycle shall be equipped with a
braking system which will stop the pedalcycle in 15 feet from an initial
speed of 15 miles per hour on a dry, level and clean pavement.
J.
Pedalcycles on sidewalks and bike paths.
(1)
Right-of-way to pedestrians. A person riding a pedalcycle
upon a sidewalk or bike path used by pedestrians shall yield the right-of-way
to any pedestrian and shall give an audible signal before overtaking
and passing a pedestrian.
(2)
Business districts. A person shall not ride a pedalcycle
upon a sidewalk in a business district unless permitted by official
traffic control devices, nor when a usable pedalcycle-only lane has
been provided adjacent to the sidewalk.
K.
Parking. Pedalcycles shall be parked in areas designated
for this purpose, whenever available. In any event, parked pedalcycles
shall not be placed so as to impede normal and reasonable movements
of pedestrian or other traffic.
A.
Any person violating or failing to comply with any
of the parking regulations of this chapter shall be fined not more
than $25 for each and every offense and costs.
B.
Any person or persons, firm or corporation who or
which shall violate any of the provisions of this chapter shall be
liable to a fine of not more than $600, plus costs of prosecution,
including reasonable attorney's fees. If the defendant neither pays
nor timely appeals the judgment, the Township may enforce the judgment
pursuant to the applicable rules of civil procedure.
C.
For purposes of this chapter, each day that an offense
continues shall be considered to be a separate and additional offense
and each offending vehicle owned, operated or in control of any person,
firm or corporation, shall render such person, firm or corporation
to have committed a separate additional offense.
A.
In accordance with the Pennsylvania Motor Vehicle
Code, Act 81 of 1976, Chapter 61, Section 6109(b)(2)[1] pertaining to specific powers of department and local
authorities, the Traffic Commission of the Township of Lower Makefield
is hereby established.

C.
The Commission shall have the power to consider, survey
and establish regulations within the Township as provided under Section
6109 of the Motor Vehicle Code of Pennsylvania.[2] The Commission shall have the power to request the Township
Engineer and Township Solicitor to assist, when necessary, in the
proceedings of the Commission.

D.
No action shall be taken except by affirmative vote
by at least two members of the Commission.
E.
Final action on the recommendations of the Commission
may be taken by the Board of Supervisors.
