No person, firm or corporation shall sell a dwelling or dwelling unit or permit the same to be sold without first obtaining a certificate of habitability, nor shall any person, firm or corporation buying a dwelling or dwelling unit and intending to occupy the same, do so, without securing a certificate of habitability, as hereinafter provided.
No person, firm or corporation shall occupy, rent, lease, let or permit to be occupied and dwelling or dwelling unit without first obtaining a certificate of habitability, as hereinafter provided.

The Zoning Officer of the Borough of Netcong is hereby designated as the enforcement officer to exercise the powers prescribed by this chapter. He/She shall serve in such capacity without any additional compensation.

A. 
All applications for certificates of habitability shall be made in writing to the Zoning Officer and shall state:
(1) 
The names and addresses of the owner or owners;
(2) 
A description of the dwelling or dwelling unit to be sold or rented; and
(3) 
The names and addresses of any agent, person, firm or corporation, if any, appointed by said owner for the management of same.
B. 
The fee for a certificate of habitability shall be paid in full at the time the application for such certificate is filed. The fee for each inspection of a dwelling unit shall be $35. The fee for a reinspection of a dwelling unit, if required, shall be $20. All fees paid for the issuance of a certificate of habitability shall be nonrefundable.

No certificate of habitability shall be issued unless and until the Zoning Officer, upon inspection, determines that the dwelling unit is safe and fit for human habitation, and complies with the provisions of the applicable statutes, housing and health ordinances of the Borough of Netcong and any other applicable Borough ordinances. In the event that upon inspection violations are found to exist, the Zoning Officer shall notify the owner of the same and request correction within such period determined by such official to be sufficient for said corrections to be completed. Upon corrections being made, a certificate of habitability shall be issued.

Any person, firm, or corporation violating any of the provisions of this chapter shall be subject to such penalties as are provided for in Article I of Chapter 1 of the Code of the Borough of Netcong.
