A.ย 
It shall be mandatory for all person who are owners, lessees and occupants of residential property, of business and industrial properties, and of private or public and government institutions and buildings, to separate newspaper, corrugated cardboard, clean mixed paper, aluminum cans, tin and bimetal cans, glass bottles and jars, and pourable plastic bottles ("designated recyclableโ€) from all other solid waste produced by such residences and establishments, for the separate collections and ultimate recycling of such materials.

B.ย 
Residences, businesses and institutions provided with recyclables collection by the Borough shall place all designated recyclables curbside in a manner and schedule as regularly published and distributed by the Borough. Any business or institution not provided collection by the Borough shall be responsible for arranging the appropriate separation, storage, collections and ultimate recycling of all designated recyclables.

C.ย 
In accordance with existing state regulations (N.J.A.C. 14A:3-11), all service stations, oil retailers and motor vehicle reinspection stations with used-oil holding tanks shall accept up to five gallons at a time of used motor oil from individuals changing oil from cars, lawn mowers or motorcycles and shall post a sign informing the public that they are a used-oil collection site.
D.ย 
Leaves shall be kept separate from other vegetative waste and shall only be placed for collection in the manner and schedule as shall be published by the Borough of Oceanport.

E.ย 
It shall be mandatory to include demolition materials in the list of recycling materials for all residential and nonresidential recycling programs.
F.ย 
It shall be mandatory for all nonresidential establishments not served by the municipal recycling program to provide a record to the municipality of the types and quantities of materials recycled. The report shall be prepared upon such forms as shall be promulgated by the Recycling Coordinator and shall be filed with the Recycling Coordinator for each calendar quarter not later than 15 days following the expiration of each such calendar quarter. Weights receipts and/or letters on official company stationery shall clearly describe the quantity and disposition of each material included in the quarterly report.
G.ย 
It shall be mandatory to separate grass clippings from household waste and shall be managed by grasscycling, home composting or delivery to an authorized compost site.
H.ย 
Automotive and other vehicle or wet-cell batteries, motor oil and antifreeze shall not be disposed as solid waste. Such items are to be kept separate from other waste material and recyclables, and brought to local service stations, scrap yards or publicly operated facilities permitted to handle such products.

I.ย 
The following bulky recyclables shall not be placed with solid waste at the curbside for pickup: concrete, asphalt, brick, block, tree stumps, tree limbs over three inches in diameter, tires, metal appliances or bulk metal items larger than one cubic foot and/or heavier than five pounds.

It shall be mandatory for all commercial and residential construction to separate all demolition materials for recycling.

K.ย 
Common, non-rechargeable dry-cell batteries, commonly labeled "A," "AA," "AAA," "C," "D" and "9 Volt," may be disposed with the regular municipal solid waste; however, rechargeable dry-cell and button batteries shall be separated and brought to publically operated facilities or retail outlets permitted to handle such products.

Effective January 2, 2011, computers, computer monitors and other related electronic hardware, as well as analog and digital television must be separated and brought to publically operated facilities or retail outlets permitted to handle such products.

As used in this article, the following terms shall have the meanings indicated:
ALUMINUM CANS
All disposable cans made of aluminum used for food or beverages. Specifically excluded are aluminum foils, pie tins, trays, cookware and other aluminum products.
CLEAN MIXED PAPER
High-grade bond paper, mixed office and school papers, such as stationery, construction paper and writing tablets, including computer printouts, magazines, gift-wrapping paper, hard- and soft-cover books, junk mail and single-layer cardboard (chipboard). Specifically excluded are carbon papers, paper cups and plates, food wrappers or any other paper contaminated by direct contact with food products and paper products used for personal hygiene, such as tissues.
CORRUGATED CARDBOARD
Layered cardboard including a waffled section between the layers, of the type commonly used to make boxes and cartons. Specifically excluded are waxed cardboard and any cardboard contaminated by direct contact with food, such as pizza boxes.
DEMOLITION MATERIALS
Includes asphalt, concrete and wood wastes.
GLASS BOTTLES AND JARS
Transparent or translucent containers made from silica or sand, soda ash and limestone, used for the packaging or bottling of various products. Specifically excluded are dishware, light bulbs, window glass, ceramics and other glass products.
NEWSPAPERS
Paper of the type commonly referred to as newsprints; includes any inserts which are normally included in the newspaper. Specifically excluded are any pages of newspaper used for household projects and crafts, such as painting or papier-mache projects or used for cleanup of pet waste.
POURABLE PLASTIC CONTAINERS
Plastic bottles where the neck is smaller then the body of the container, and is limited to plastic resin type No. 1 PET and plastic resin type No. 2 HDPE. Specifically excluded are other resin types (Nos. 2 through 7) and non-bottle plastic containers, such as margarine tubes and other consumer items and packages, such as film plastics, blister packaging, boxes, baskets, toys and other products.
TIN AND BIMETAL CANS
Disposable cans made of tin, steel or a combination of metals, including but not limited to containers commonly used for food products. Specifically excluded are cans which contain toxic products such as paints or oils.

A.ย 
The position of Recycling Coordinator is herby created and established within the Borough of Oceanport and shall be appointed by the Borough Council for a term of one year expiring December 31 of each year. The term of the person first appointed as Recycling Coordinator or any appointment due to a vacancy shall expire December 31 of the year of that person's appointment.
B.ย 
The duties of the Recycling Coordinator shall include, but are not limited to, the preparation of the annual or other reports required by state and county agencies regarding the local solid waste and recycling programs, reviewing the performance of local schools and municipal agencies in conducting recycling activities, periodic review of local residential and business recycling practices and compliances, reports to the governing body on the implementation and enforcement of the provisions of this article and such other reports and activities as may be requested by the governing body.
C.ย 
The Recycling Coordinator shall be required to comply with the certification requirements for Municipal Recycling Coordinators, as established by the State of New Jersey. The Recycling Coordinator shall have completed or be in the process of completing the requirements for the certification as a "Certified Recycling Professional" (CRP) no later than January 13, 2010, as required by the New Jersey Recycling Enhancement Act.[1]

A.ย 
The Borough Council may use municipal personnel to collect recyclable material set forth herein at curbside and/or from a dropoff center and shall sell said recyclable material if a market exists therefor pursuant to N.J.S.A. 40A:11-1 et seq.
B.ย 
The Borough Council may elect to enter into agreements with qualified persons or corporations authorizing them to collect said recyclable material at curbside or from a dropoff center and to sell said recyclable material, provided that the amount of money realized exceeds the cost of collection.
A.ย 
Recyclable material as defined herein shall be the property of the Borough of Oceanport once placed on the curbside or brought to a dropoff center.
B.ย 
It shall be a violation of this article for any person unauthorized by the Borough Council to pick up or cause to be picked up said recyclable material as defined herein. Each such collection in violation hereof shall constitute a separate and distinct offense punishable as hereinafter provided.
Anything herein to the contrary notwithstanding, any person, partnership or corporation who is owner, lessee or occupant of a residential or nonresidential property may donate or sell said recyclable material as defined herein to any person, partnership or corporation, whether or not operating for profit. Said person, partnership or corporation, however, shall not pick up said recyclable materials at curbside or at a municipal dropoff center.

It shall be unlawful for any person or entity not a lawful resident of the Borough of Oceanport or any owner or occupant of a nonresidential establishment to deposit or place any recyclable materials either at a municipal dropoff center or at any other location within the Borough.
A.ย 
Any person, firm or corporation who violates or neglects to comply with any provision of this article or any rule or regulation promulgated pursuant thereto shall be punishable, upon conviction thereof, by a fine as set forth in Chapter 1, ยงย 1-15, General penalty, except that the maximum fine or penalty for the failure to comply with ยงย 325-5A and B thereof, or any rule or regulation promulgated pursuant thereto, shall not exceed $50. As an alternate penalty, a convicted person may be ordered to perform community service in the recycling program for a period not to exceed 90 days.

B.ย 
Each day such violation or neglect is committed or permitted to continue shall constitute a separate offense and be punishable as such.
C.ย 
The Municipal Recycling Coordinator, the Monmouth County Health Department and the Police Department are hereby jointly and severally empowered to inspect solid waste and recycling arrangements and compliance at local residences, businesses, schools and institutions and to enforce the provisions of this article, by issuance of warnings, notices or summonses.
