A. 
Any member of the Paulsboro Fire Department who refuses or neglects to obey or execute orders from the officer in charge at any fire, fire drill, or for the care and maintenance of equipment, or who refuses to observe the provisions of this ordinance and any rules and regulations adopted hereunder of the Paulsboro Fire Department, shall, upon a 2/3 or majority vote of the members in attendance at any meeting, after a fair and impartial hearing before the Executive Committee, be subject to such disciplinary action as may be recommended by said members of the Paulsboro Fire Department and his/her association, which may be suspension and/or dismissal from the Paulsboro Fire Department and his/her association. Any member suspended under this section, or suspended by action of the Paulsboro Fire Department and/or his/her association, shall not participate in the fighting of fires and fire drills or care of equipment, and, if dismissed from the Paulsboro Fire Department or his/her association, shall return and surrender all fire equipment in his/her custody to the officers of the Paulsboro Fire Department and the association of which he/she belongs. Should the Paulsboro or Billingsport Volunteer Fire Association or the Paulsboro Fire Department not take action against any member for violations, as aforesaid, the Mayor and Council may make inquiry or hold a private hearing, at which time the said member shall be given an opportunity to be heard. Mayor and Council shall examine the facts and, at the conclusion of the same, take such disciplinary action against the offending member as the facts in its opinion may warrant, which may include suspension or dismissal from the Paulsboro Fire Department of the Borough of Paulsboro.
B. 
The Fire Chief and Chief Fire Marshal shall not be removed from office except for malfeasance in office or dereliction of duty. Any charges to remove them from office must be signed by at least five members of the Billingsport Fire Association and five members of the Paulsboro Volunteer Fire Association #1 and who is a member of the Paulsboro Fire Department as provided in § 33-1. A joint meeting of both associations whose members shall have the qualifications as set forth in § 33-1, to be presided over by the Mayor, Director of Public Safety, or the President of Council, shall be called to take testimony against said officer and give any such officer charged an opportunity to be heard and present evidence on his/her, behalf, and, if the charges are found to be true, to determine what disciplinary action is to be taken. Said determination shall be by secret ballot. If any such officer is removed from office, an election shall be held to replace him/her. In the event a fire fighter is a member of Council, he/she shall not preside over this meeting.
