§ 34A-1 Local enforcement.

Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c.383),[1] the New Jersey Uniform Fire Code (N.J.A.C. 5:70-1 et seq.) shall be locally enforced by the County of Gloucester.

§ 34A-2 Agency designation.

The local enforcing agency shall be the Gloucester County Fire Marshall's Office.

§ 34A-3 Duties of local enforcing agency.

A. 
The local enforcing agency shall enforce the Uniform Fire Code[1] in all buildings, structures, and premises within the established boundaries of the Borough of Paulsboro other than one- and two-unit owner-occupied dwellings used exclusively for dwelling purposes and buildings, structures, and premises owned or operated by the federal government, interstate agencies or the State of New Jersey.

B. 
The local enforcing agency shall faithfully comply with all the pertinent requirements of the Uniform Fire Safety Act[2] and the Uniform Fire Code.

§ 34A-6 Life-hazard uses.

The County of Gloucester shall carry out the periodic inspections of life-hazard uses required by the Uniform Fire Code on behalf of the Commissioner of the New Jersey Department of Community Affairs.

§ 34A-7 Non-life-hazard uses.

Registration of non-life-hazard uses shall be as required by the Uniform Fire Code or the County of Gloucester.

§ 34A-14 Purpose.

It is the purpose of this ordinance to allow the Fire Department and its personnel to gain immediate and reliable access to structures within the Borough in order to ensure proper lifesaving and other firefighting purposes where access to structures is unduly difficult because of secured openings or other hazards.

§ 34A-15 Key box required.

When access to or within a structure or an area is unduly difficult because of secured openings or where immediate access is necessary for lifesaving or for firefighting purposes, the Fire Chief or County of Gloucester, where appropriate, may require a key box to be installed in an accessible location. The key box shall be a type approved by the Fire Chief and County of Gloucester, as appropriate, so that all key access of this type within the Borough of Paulsboro may be accomplished with one system. The key box shall contain keys to gain necessary access as required by the Fire Department.

§ 34A-16 Installation.

The location and installation of the key box shall be in accordance with specifications maintained and approved by the County of Gloucester in consultation with the Fire Chief, as required. The Fire Chief and County of Gloucester shall have the authority to implement a uniform system throughout the Borough so that access to the designated key boxes may be accomplished by the utilization of one uniform key system. In the event the key to the structure is changed or rekeyed, the owner/operator of the building shall immediately notify the Fire Chief and the County of Gloucester or their designee(s) and provide the updated access key. The key to the lock shall be secured in the key box. The property owner shall assume all associated costs for the purchase and installation of a key box(es).

§ 34A-17 Enforcement.

The enforcement of the provisions of this ordinance shall be the responsibility of the County of Gloucester in accordance with the provisions of the Uniform Fire Code of the State of New Jersey.

§ 34A-19 Repealer.

Any ordinance or parts of ordinances inconsistent with this ordinance are hereby repealed to the extent of any such conflict or inconsistency.

§ 34A-20 Severability.

If any section, subsection, paragraph, subdivision, sentence, clause, phrase or provision of this ordinance shall for any reason be held unconstitutional or invalid, such adjudication shall apply only to the section, subsection, paragraph, subdivision, sentence, clause, phrase or provision so adjudged, and the remainder of the ordinance shall be deemed valid and effective.

§ 34A-21 When effective.

This ordinance shall take effect immediately after passage and publication as provided by law.
