The Borough of Paulsboro hereby creates a separate class of users titled "discharges from contaminated groundwater sites."
Requests for service from individuals, partnerships or corporations proposing to discharge effluent from a contaminated groundwater site shall be evaluated for provision of service and subject to the following conditions:
A. 
Each request from a groundwater decontamination site will be considered and evaluated on a case-by-case basis. Criteria for consideration and evaluation shall include, but not be limited to, the following:
(1) 
The advice and consent of the local governmental entity owning and operating a local sewage collection system when the proposed discharge from a groundwater decontamination site will enter the Borough of Paulsboro conveyance and treatment system after first being collected by a local sewage collection system.
(2) 
The type, degree and extent of the contamination at the specific site.
(3) 
The specific remedial technology proposed to be used to cleanse the contaminated groundwater.
(4) 
Conformance to applicable federal, state and local standards.
(5) 
Possible and potential adverse effects the discharge may have on the Borough of Paulsboro personnel, Borough of Paulsboro facilities, Borough of Paulsboro operational procedures and standards and conditions imposed by the several and various federal and/or state permits governing Borough of Paulsboro facilities.
(6) 
The length of time estimated to undertake and complete the groundwater decontamination.
(7) 
The availability of present and future capacity within the entire Borough of Paulsboro conveyance and treatment system.
(8) 
The range of other disposal options open to each specific groundwater site.
B. 
Each discharger determined to be this class of user and its discharge accepted into the Borough of Paulsboro will be subject to the following business conditions:
(1) 
Each discharger shall have all terms and conditions incorporated and embodied in a service agreement duly executed by the discharger and the Authority.
(2) 
The service charge for this class of user shall be at a rate three times the basic service charge established annually by the Borough of Paulsboro. The discharger shall also be subject to any and all surcharges established therein, if applicable.
(3) 
Each discharger in this class of user accepted by the Borough of Paulsboro for service shall be subject to payment of the Authority's prevailing charge under the Borough of Paulsboro's construction expansion fee program. This charge will be nonrefundable.
Any discharger determined to be of this class of user and accepted into the Borough of Paulsboro system shall be subject to severability under certain conditions:
A. 
Violation of federal, state or local statutes, regulations or programs.
B. 
If and when the capacity of the Borough of Paulsboro conveyance system, treatment plant or a combination thereof is reached due to demand for new development, the groundwater decontamination site's service agreement may be severed. Service agreement severance shall require formal notification by the Borough of Paulsboro. In no case shall this notification be less than 180 days prior to severance.
