There is hereby created within the Township of Pemberton the position of "Township Public Defender" pursuant to N.J.S.A. 2B:24-1 et seq. The Council shall appoint an attorney licensed to practice law in the State of New Jersey to serve as Public Defender for the Township of Pemberton for a one-year term and/or until his or her successor is appointed and qualified. Said appointment shall be made pursuant to a professional services contract as set forth in § 3-38 below. The Township Public Defender shall represent those individuals who apply and qualify for representation and are determined by the Municipal Court Judge to be entitled to representation by the Public Defender.

Any person applying for representation by the Township's Public Defender shall first pay an application fee of $200 for said representation. The Municipal Judge may, in the Judge's discretion, and based upon evidence submitted to the Municipal Judge, waive said application fee, in full or in part, if the Judge determines that the application fee represents an unreasonable burden on the person seeking such representation.
