The purpose of this article is to establish
a Municipal Alliance Council in accordance with the provisions of
N.J.S.A. 26:2BB-1 et seq., an specifically N.J.S.A. 26:2BB-9, which
authorizes the governing body of each municipality to appoint a "Municipal
Alliance Committee" which, in consultation with the Local Advisory
Committee on Alcoholism and Drug Abuse, is to identify alcoholism
and drug prevention, education and community needs. This Committee
is also required to implement the Alliance programs formulated pursuant
to the provisions of N.J.S.A. 26:BB-8. In addition, this Municipal
Alliance Committee is permitted to apply for funding in accordance
with the procedures established under regulations promulgated by the
Department of the Treasury found at N.J.A.C. 17:40-1.1 et seq.
There is hereby established the Pemberton Township
Municipal Alliance Committee which shall continue to operate under
the familiar name of "Pemberton Township Alliance Group" or its acronym
"TAG".
The Municipal Alliance Committee shall undertake
to meet all of the responsibilities and perform all of the duties
and functions of municipal alliance committees established by state
statute and regulation. The Township Council specifically incorporates
herein by reference the provisions of N.J.A.C. 17:40-2.5 and 17:40-2.6,
and such other provisions of the state regulations which govern the
operation of municipal alliance committees created pursuant to the
authority of N.J.S.A. 26:2BB-1 et seq.
The Township Council recognizes that portions
of the funding made available to the Alliance are permitted to be
used as stipends for individuals performing necessary services on
behalf of the Alliance. Accordingly, the Alliance shall be permitted
to provide appropriations in its annual budget, subject to review
and approval by the Township Council, for stipends to be paid to individuals
for these services. The hiring of said individuals, however, shall
be subject to review and approval by the Mayor and Council. Stipends
shall be paid directly by the Alliance to the individuals, but said
individuals shall not be considered employees of the Township of Pemberton.
The Township shall annually enter into an agreement
with the County of Burlington for participation in the county alliance
programs. The Municipal Alliance Committee organized and established
herein shall implement said plan in accordance with the provisions
of N.J.S.A. 26:2BB-9 and N.J.A.C. 17:40-2.5(b). Moreover, the Alliance
may apply for funding through the procedures described at N.J.A.C.
17:40-1.1 et seq. The Township, however, is ultimately responsible
for these funds. Accordingly, the Alliance shall, as indicated above,
submit its annual budget to the Township Council for review and approval.
In addition, all funding received by the Alliance shall be reported
to the Chief Financial Officer, and all payments made by or on behalf
of the Alliance shall first be submitted to the Township Council in
the way of vouchers or purchase orders for review and approval. In
the event that the Alliance applies for grants, which are available
to it under various state programs, approval of the Township Council,
by motion or resolution, shall first be required before the funding
can be sought.
