These rules, regulations and standards shall
be considered the minimum requirements for the protection of the public
health, safety and welfare of the citizens of the Township of Pemberton.
Any action taken by the municipality under the terms of this chapter
shall give primary consideration to the above-mentioned matters and
to the welfare of the entire community. However, no additional right-of-way
or improvements will be required for subdivisions with minor adjustments
in boundaries between two existing lots which do not result in the
creation of any new lots.
A. Public hearings on each application shall be held in accordance with §
190-59D of the Zoning Ordinance.
B. Notice of decisions on each application shall be given in accordance with §
190-59F of the Zoning Ordinance.
C. Records shall be kept in accordance with §
190-59C of the Zoning Ordinance.
D. Appeals. Nothing in this chapter shall be construed
to restrict the right of any party to obtain a review by any court
of competent jurisdiction according to law.

The Township Council hereby adopts the checklist
attached hereto and made a part hereof.

All public purpose uses within the Pinelands
Area shall conform to the provisions of this chapter and N.J.A.C.
7:50-4.51 et seq.

This chapter may be amended from time to time
by the Township Committee after the appropriate referrals, notices,
hearings, other requirements of law and compliance with N.J.A.C. 7:50-3.45.

This chapter shall take effect immediately upon
adoption, publication according to law and certification by the Pinelands
Commission pursuant to N.J.A.C. 7:50-3.31 through 50-3.34.
