This article is intended to address a problem
that has arisen within the Township of Pemberton relating to the parking
of nonemergency vehicles in areas designated as fire zones or fire
lanes. The parking of such nonemergency vehicles in such areas seriously
impedes the ability of local emergency response teams and fire companies
to respond to fires and emergencies.

No unauthorized vehicles shall be allowed to
park, stand or stop in any fire lane, nor shall any person in any
manner obstruct any fire lane. Any violation of this section shall
be subject to a fine not to exceed $500 for each separate offense.
"Unauthorized vehicle" shall be interpreted to mean a vehicle other
than an emergency vehicle, as well as such other vehicles as may be
designated by the Township Engineer as being authorized.

Any occupied or unoccupied unauthorized vehicle
parked, standing or stopped in violation of this article shall be
deemed a nuisance and menace to the safe and proper administration
of both fire safety and emergency response efficiency and any police
officer or fire inspector may issue a summons to the owner of such
vehicle and may further provide for the removal of such vehicle. The
owner shall pay the reasonable cost of the removal and storage, which
may result from such removal before regaining possession of the vehicle.
A.
Unless another penalty is expressly provided by New
Jersey statute, every person convicted of a violation or provision
of this Article or any supplement hereto shall be liable for a penalty
of not less than $50 nor more than $200, or imprisonment for a term
not to exceed 15 days, or community service for a term not to exceed
15 days.
B.
Notwithstanding the penalties above set forth, the
Township shall be entitled to pursue any other remedy available at
law or equity to enforce the provisions hereof.

Enforcement officials shall constitute the Fire
Inspector, as defined pursuant to the Uniform Fire code, N.J.A.C.
§ 5:70-1.5, and the Township Police Department, and they
shall have concurrent jurisdiction to enforce the provisions of this
section.
