A certain document, three copies of which are on file in the
office of the Township Clerk, being marked and designated as the "International
Property Maintenance Code 2015" as published by International Code
Council (ICC), Inc., be and is hereby adopted as the Property Maintenance
Code of the Township of Pennsauken in the State of New Jersey for
the control of buildings and structures herein provided; and except
for Section 111 in its entirety, each and all regulations of the ICC
International Property Maintenance Code 2015, is hereby referred to,
adopted and made a part hereof as if fully set out in this article.
There is hereby established in the Township
of Pennsauken a Code Enforcement Section to be adequately staffed
by personnel who are trained and qualified to enforce the Property
Maintenance Code of the Township of Pennsauken, and all other Township
ordinances as required by the direction of the Township Committee.
The Code Enforcement Section shall be responsible for all inspections
as they relate to the enforcement of the Township ordinances, Property
Maintenance Code, for the processing of complaints regarding unsafe
and dangerous conditions and for assisting the Construction Official
in the inspection process.
The fee for an occupancy certificate for existing
structures without change of use shall be as follows:
A. For a space or building less than 1,000 square feet:
$75.
B. For a space or building 1,000 square feet or more
but less than 5000 square feet: $100.
C. For a space or building 5,000 square feet but less
than 10,000 square feet: $125.
D. For a space or building 10,000 square feet or more:
$150.
E. For a temporary exterior mercantile space, excluding
residential yard sales, not exceeding 30 days: $50.

Any person who shall violate a provision of
the International Property Maintenance Code, adopted as the Property
Maintenance Code of the Township of Pennsauken, shall, upon conviction
thereof, be subject to one or more of the following: a fine not exceeding
$2,000 or imprisonment in the county jail for a term not exceeding
90 days, or a period of community service not exceeding 90 days, in
the discretion of the Municipal Court Judge. Each day that such violation
shall continue after due notice has been served shall be deemed a
separate offense.

Amendments to the ICC International Property Maintenance Code
2015 as follows:
A. Section 302.4, Weeds, of the ICC International Property Maintenance
Code 2015 is hereby amended to read, "All premises and exterior property
shall be maintained free from weeds or plant growth in excess of eight
inches." The remainder of the code section stays as written.
B. Section 302.8, Motor vehicles, of the ICC International Property
Maintenance Code 2015 is hereby amended to read, "Except as provided
for in other regulations, no inoperative, unlicensed, uninspected,
uninsured or unregistered motor vehicle shall be parked, kept or stored
on any premises, and no vehicle shall be at any time in a state of
major disassembly, disrepair, or in the process of being stripped
or dismantled." The remainder of the code section stays as written.
C. Section 303.2, Enclosures, of the ICC International Property Maintenance
Code 2015 is hereby amended to read: "Private swimming pools, hot
tubs, spas, and ornamental ponds, containing water 18 inches in depth
or above and eight feet in width shall be completely surrounded by
a fence or barrier at least 48 inches in height above the finished
ground level measured on the side of the barrier away from the pool,
hot tub, spa or ornamental pond, unless a legal permit under the Uniform
Construction Code of the State of New Jersey was issued, inspected
and passed prior to the adoption of this code." The remainder of the
code stays as written.
D. Section 304.7.1, Roof certification, is added to the ICC International
Property Maintenance Code 2015 to read: "A roof certification by a
roofer or contractor licensed in the State of New Jersey or the Township
of Pennsauken, whichever is applicable, for the roof is required.
It shall read that the roof is sound and watertight."
E. Section 504.3.1, Plumbing system certification, is added to the ICC
International Property Maintenance Code 2015 to read: "A plumbing
certification by a plumber licensed in the State of New Jersey for
the plumbing system is required. It shall read that the plumbing system
is operating properly and all visible piping, valves, faucets, etc.,
are installed, working and show no visible signs of leaking." The
plumbing certification shall be sealed with a New Jersey master plumber's
seal.
F. Section 602.3, Heat supply, dates to be October 1 to May 1.
G. Section 603.7, Mechanical systems certification, is added to the
ICC International Property Maintenance Code 2015 to read: "A mechanical
certification by a new HVAC contractor licensed as a residential or
commercial HVAC contractor, whichever is applicable, or a plumber
licensed in the State of New Jersey for all mechanical systems is
required. It shall list all of the mechanical systems that were inspected
and state that all of the listed systems are installed and working
properly." The certification shall be sealed by a commercial HVAC
license holder or by a plumber licensed in New Jersey. Residential
mechanical system certifications are not required to be sealed.
H. Section 604.4, Electrical system certification, is added to the ICC
International Property Maintenance Code 2015 to read: "An electrical
system certification by an electrician licensed in the State of New
Jersey is required. It shall read that the electrical system is installed
and working properly. All visible fixtures, outlets and other appurtenances
have been checked and are working, installed properly and there are
no visible hazards or defects. It shall be sealed by an electrician
licensed in New Jersey."
I. Section 704.2, Single and multiple-station smoke alarms, shall be
amended to read as follows: "Single and multiple-station smoke alarms
shall be installed in existing Group I-1 and R occupancies in accordance
with the New Jersey Fire Safety Code 5:70-4.9, Automatic fire and
carbon monoxide alarms."
J. Section 704.3, Certification of fire protection systems, is added
to the ICC International Property Maintenance Code 2015 to read: "A
current certification from a fire alarm company or fire suppression
systems company licensed by the New Jersey Division of Fire Safety
or New Jersey Consumer Affairs shall be supplied to show that all
systems, devices, and equipment to detect a fire, actuate an alarm
or suppress or control a fire, or any combination thereof are properly
maintained."
K. Section 704.4, Fire Department connections, is added to the ICC International
Property Maintenance Code 2015 to read: "All fire sprinkler and standpipe
supply connections shall be of a four-inch stortz type unless specified
by the current New Jersey Uniform Construction Code."
L. Section 705, Hazardous materials, is added to the ICC International
Property Maintenance Code 2015.
M. Section 705.1, Storage of hazardous materials, is added to the ICC
International Property Maintenance Code 2015 to read: "Hazardous materials
as defined in the International Fire Code 2015 shall not be stored
unless they comply with the New Jersey Uniform Construction Code and
the Uniform Fire Code."
