GENERAL REFERENCES
Fire prevention — See Ch. 112.
As used in this chapter, the following terms shall have the meanings
indicated:
Any item used to extinguish any fire or stop or contain any leak
or spill involving any hazardous material which can neither be reused nor
replenished without cost after the particular fire, leak or spill. Such items
include but they are not limited to fire-fighting foam, chemical extinguishing
agents, absorbent material, sand, recovery drums and such specialized protective
equipment as acid suits, acid gloves, goggles, protective clothing and similar
items.
Any material, solid, liquid or gas, listed as such under the NFPA
Guide of Hazardous Materials and the Department of Transportation Guide Book.
Any motorized equipment, registered or unregistered, including but
not limited to a passenger car, motorcycle, truck, tractor trailer, construction
equipment and farm machinery.
Any container, drum, box cylinder or tank used to hold or contain
or carry or store any hazardous material.
A.
This chapter provides for the reimbursement for or the
replacement of the specialized and nonreusable equipment required by state
and federal regulations to be made available by the Township of River Vale
in case of fire, leakage or spillage involving a hazardous material.
B.
This chapter entitles the Township of River Vale to reimbursement
for expendable items used by the Township of River Vale or any of its agencies
in extinguishing any fire, stopping or containing any leak or controlling
any spill of hazardous materials.
Reimbursement to the Township of River Vale for expendable items used
shall be made by:
A.
The owner or operator of the vehicle responsible for
the fire, leak or spill of hazardous material.
B.
The owner or person responsible for the vessel containing
the hazardous material involved in such fire, leak or spill on public or private
property, whether stationary or in transit and whether accidental or through
negligence.
C.
The owner or person responsible for any property from
which any leak or spill of hazardous material emanates, whether accidental
or through negligence.
D.
The person responsible for the fire, leak or spill of
hazardous material on public or private property, whether accidental or through
negligence.
The person or entity responsible for a fire, leak or spill involving
a hazardous material shall reimburse the Township of River Vale the cost of
services rendered by a recovery company, towing company or other person or
firm engaged by the Township of River Vale to handle such incident.
The person or entity responsible for any fire, leak or spill of hazardous
materials shall reimburse the Township of River Vale the costs aforesaid,
together with the full price of expendable items used to extinguish such fire
or to stop or contain such leak or to control such spill, within 45 days after
receipt of a bill therefor.
