This chapter shall be known and may be cited as the "Cooperative Purchasing Ordinance of the Borough of Rutherford."
Pursuant to the provisions of N.J.S.A. 40A:11-10 to 40A:11-12, the Borough of Rutherford is hereby authorized to enter into an agreement with the County of Bergen or any other contracting unit within the County of Bergen or adjoining counties for the purchase of work, materials and supplies.
The Purchasing Agent of the Borough of Rutherford is hereby authorized and empowered to execute on behalf of the Borough of Rutherford all such agreements as may be required to administer this chapter as per Chapter 81, § 81-13, of the Borough Code, and approved by the Mayor and Council.
The contracting unit entering into the contracts on behalf of the Borough of Rutherford shall be responsible for complying with N.J.S.A. 40A:11-1 to 40A:11-39 and all other provisions of the Revised Statutes of the State of New Jersey.
Nothing contained in this chapter or any agreement shall require the borough to make any purchase or obligation, nor prevent any party from awarding contracts of purchase on its own behalf, for the same work, materials and supplies as provided in the Joint Purchasing Agreement.
This chapter shall take effect immediately upon passage and publication according to law.

A. 
Pursuant to the provisions of N.J.S.A. 40A:11-11(5), the Mayor and Borough Clerk are hereby authorized to enter into a cooperative pricing agreement with the County of Bergen as the lead agency for the purchase of work, materials and supplies.
B. 
The lead agency entering into contracts on behalf of the Borough of Rutherford shall be responsible for complying with the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) and all other provisions of the Revised Statutes of the State of New Jersey.
