A. 
Unless another penalty is expressly provided by New Jersey statute or another section of this chapter, every person convicted of a violation of the provisions of this chapter or any supplement thereto shall be liable to the penalties set forth in N.J.S.A. 39:4-203.
B. 
Violation of certain sections.
(1) 
Any person violating Articles IV through VIII of this chapter may avoid a court appearance for the first or second offense by pleading guilty and paying the following fine:
(a) 
First offense: $35.
(b) 
Second offense: $60.
(2) 
Any person charged with a third or subsequent offense shall be required to make a court appearance and be subject to the penalties set forth in § 223-38.
