No public dance hall, cafe, cabaret, hotel, restaurant, saloon of any kind or place of public amusement shall be conducted, maintained or operated in this city without a mercantile or other license having been first had and obtained therefor as provided by the ordinance of the City of Somers Point[1] and the statutes in such case made and provided.

All such public dance halls, cafes, cabarets hotels, restaurants, saloons of any and every kind and places of public amusement so licensed shall be so operated, maintained and conducted that they, or any of them, shall not in any case be or become a public nuisance.
A. 
All such public dance halls, cafes, cabarets and saloons of any kind shall be closed at or before the hour of 1:00 a.m. on Mondays, Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays, and they shall be closed at or before the hour of 12:00 midnight on Saturdays.
B. 
There shall be no public dancing, musical concert, theatrical entertainment or other entertainment or exhibition of any kind or character in any such public dance halls, cafes, cabarets or saloons between the hours of 1:00 a.m. and 9:00 a.m. on Mondays, Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays or between the hours of 12:00 midnight on Saturdays and 9:00 p.m. on Mondays.
C. 
All such public dance halls, cabarets and saloons of any kind shall be closed between the hours of 1:00 a.m. and 7:00 a.m. on Mondays, Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays and between the hours of 12:00 midnight on Saturdays and 7:00 a.m. on Mondays.
D. 
All cafes shall be closed between the hours of 1:00 a.m. and 6:00 a.m. on Mondays, Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays and between the hours of 12:00 midnight on Saturdays and 6:00 a.m. on Sundays.
E. 
All public dance halls, cafes, cabarets, hotels, restaurants and saloons of any kind shall cease outdoor musical concerts and/or outdoor musical bands and the outdoor playing of music from any sound reproduction device between the hours of 11:00 p.m. and 12:00 noon. The playing of musical instruments for concerts, or by bands, or the sound reproduction of music by any sound reproduction device from a location inside the structure of such an establishment in such fashion so that it is reasonably intended that the music be projected outside the structure shall also cease at the same hour.

The entrance to or windows of such public dance halls, cafes, cabarets, hotels, restaurants, saloons of any and every kind and places of public amusement shall not be so screened or obstructed by any device or screen so that the interior thereof shall not be visible or may not be seen from the exterior or outside thereof.
Any person, persons or corporation or corporations violating any of the provisions of this article or who shall fail to prevent disorderly persons and known disreputable persons from frequenting any of the places mentioned in this article or who shall permit objectionable lounging and loafing at or near the entrance or entrances to such places or who shall permit brawls or other great disorder therein may be summoned to appear before the Common Council, by notice served upon the offending party personally or left at his residence or place of business at least five days before the time set for hearing, specifying the matters herein referred to complained of against him; and, upon hearing thereof, the Common Council shall have the power to revoke the mercantile or other license issued to such offender hereunder, which license shall, from thenceforth, be null and void, and further conduct of the licensed business by such offender after such revocation shall be prohibited.

Any person, persons or corporation or corporations violating any of the provisions of this article shall, upon conviction before the Municipal Court Judge of the City of Somers Point or other proper official having authority to hear and determine such violation, pay a fine not exceeding $1,000 or be imprisoned in the city or county jail for the term of not exceeding 90 days or undergo a period of community service not exceeding 90 days, or any combination of the foregoing.
