Article I Defined Contribution Retirement Program

[Adopted 9-9-2008 by Ord. No. 3780]

§ 60-1 Required participation positions.

Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program:

A. Township Manager;

B. Assistant Township Manager;

C. Director of Community Development;

D. Director of Revenue and Finance;

E. Director of Economic Development;

F. Director of Fire Prevention/Fire Prevention Official;

G. Director of Recreation;

H. Grants Coordinator;

I. Director of Social Services;

J. Court Administrator;

K. Township Attorney (only if employed as an employee);

L. Director of Engineering and Public Works;

M. Municipal Prosecutor (only if employed as an employee);

N. Municipal Court Judge.

§ 60-2 Exempt positions.

Individuals serving in the following positions are exempt from Defined Contribution Retirement membership, pursuant to N.J.S.A. 43:15C-2:

A. Certified Health Officer;

B. Tax Collector;

C. Chief Financial Officer;

D. Construction Code Official;

E. Qualified Purchasing Agent;

F. Tax Assessor;

G. Municipal Planner;

H. Registered Municipal Clerk;

I. Licensed Uniform Subcode Inspector;

J. Principal Public Works Manager.

§ 60-3 Legislative authority.

This article shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq.), as amended from time to time, and any regulations or guidance documents from the Local Finance Board or the Division of Pensions and Benefits.
