It is the intent and purpose of this article
to clarify the employment status of licensed professional consultants
retained by the Borough and its Boards and Commissions.
As used in this article, the following term
shall have the meaning indicated:
PROFESSIONAL CONSULTANT
Any individual who is authorized by law and licensed to practice
a recognized profession, retained or appointed by the Borough of Chester
and/or its various boards and commissions to perform services which
require knowledge of an advanced type in a field of learning acquired
by a prolonged formal course of specialized instruction and study
as distinguished from general academic instruction or apprenticeship
and training.
Any professional consultant retained by the
Borough and its various boards and commissions shall be qualified
to and shall maintain a license in good standing in the individual
consultant's recognized profession. The Borough may impose additional
qualification requirements for professional consultants from time
to time, as may be required.
Any and all professional consultants retained
by the Borough and/or its boards or commissions shall be independent
contractors and shall not be considered employees of the Borough and
shall not be entitled to any benefits associated with employment by
the Borough.
Whenever possible, all professionals shall be
retained pursuant to a written contract setting forth the services
to be rendered, the compensation to be paid and such other matters
as may be required by law or at the direction of the Borough Attorney.
Such contracts shall be subject to the review and approval of the
Borough Attorney.
