No person shall erect, construct, operate, conduct or maintain a public
garage, gasoline or oil service station or bulk gasoline or oil storage plant
in the borough, without first obtaining a permit so to do, in accordance with
the provisions hereof.
Any applicant for a permit to conduct a public garage, gasoline or oil
service station or bulk gasoline or oil storage plant in the borough shall
file an application with the Borough Clerk, setting forth the name of the
applicant, a description of the premises, its owner, and location, together
with a copy of the plans and specifications of all buildings and diagram showing
location of buildings, tanks, pumps and driveways on the premises.

A.
No part of any public garage or gasoline or oil service
station or bulk gasoline or oil storage plant or of any driveway thereto shall
be located within 200 feet of any building, or a point on the opposite side
of the street on which it falls, used as a church, hospital, public or parochial
school, if such building is located on either side of the same street or streets
upon which the public garage or gasoline or oil service station or bulk gasoline
or oil storage plant is located.
B.
No part of any building used as a public garage or gasoline
or oil service station or bulk gasoline or oil storage plant and no tank or
filling pump or other service appliance used in connection with any public
garage, gasoline or oil service station or bulk gasoline or oil storage plant
shall be erected within 25 feet of any dwelling house.
C.
No tank or gasoline or oil pump, no oiling or greasing
mechanism and no other service appliance installed in connection with any
public garage, gasoline or oil service station or bulk gasoline or oil storage
plant shall be within 15 feet of any street line.
D.
No public garage or gasoline or oil service station or
bulk gasoline or oil storage plant shall be hereafter located with or attached
to a building occupied for any other purpose, unless it is separated from
such other occupancy, and the walls, floors and ceilings enclosing it are
of fireproof or semi-fireproof construction.
Any public garage, gasoline or oil storage plant existing at the time
of enactment of this chapter may be continued upon any lot or in any building
so occupied, and any such building may be restored or repaired in the event
of partial or total destruction thereof.

A.
All gasoline filling stations in the borough shall be
closed and shall not engage in any business operations involving the sale
or dispensing of fuels, oils, goods or services, except for emergency road
services, during the hours of 12:00 midnight and 6:00 a.m.
B.
Any person who violates this section by engaging in any prohibited business operations between the hours of 12:00 midnight and 6:00 a.m., upon conviction, shall be subject to the penalties stated in Chapter 1, General Provisions, Article III, General Penalty. Each day that a violation of the provisions of this section occurs shall be considered to be a separate offense.
