For purposes of this chapter the term "public
recreational bathing place" shall have the meaning set forth in N.J.A.C.
8:26-1.3 and shall include any bathing beach and swimming pool not
located on a single-family residential lot.
At the times and in the manner prescribed in
N.J.A.C. 8:26-1.1 and following, the Board of Health shall inspect
all public recreational bathing places operated within the Borough
of Chester as well as the records regarding the operations of such
places, and the Board shall issue reports of inspections and certifications
of approval, all as required by the applicable state rules and regulations.
A.
The owner or operator of a public recreational bathing place located within the Borough of Chester shall pay to the Board of Health an annual fee of $135, which fee shall cover inspections, review of records of operation, reports of inspections and the issuance of certifications required as provided in § 251-2 of this chapter. Such annual fee shall be paid on or before January 15 of each calendar year and such fee shall not be reduced by operation of a public recreational bathing place for less than a full calendar year.

B.
The owner or operator of a public recreational bathing
place which commences its original operation after January 15 in any
year shall pay an initial annual fee of $100 for the period between
the commencement of operation and the succeeding January 15 regardless
of the length of such period, and the initial annual fee shall be
paid within 30 days after notice from the Board of Health.
C.
Payment to the Board of Health of the fee required
by this chapter shall not relieve the owner or operator of a public
recreational bathing place of the obligation to pay to any approved
laboratory the costs for the required tests or analyses of waters
of the facility.
No provision of this chapter shall affect the
provisions of any other ordinance adopted by the Board of Health,
and any fee required by this chapter shall be in addition to any other
fee required by any other ordinance.
