The Borough of Chester shall enter into a written agreement with Chestertowne Condominium Association and the Roman Catholic Diocese of Patterson- Nazareth Village Condominium (the "Community"), pursuant to the provisions of the Condominium Services Act, for reimbursement of the Community for snowplowing and streetlighting services which are accomplished at the private expense of the Community.
The Borough Attorney is hereby directed to prepare a written reimbursement agreement to be executed by the Community and the Borough.
The Mayor or Administrator is hereby authorized to execute the reimbursement agreement on behalf of the Borough.

The Community shall be reimbursed by the Borough for streetlighting in accordance with the formula established herein. The Borough may either provide snow removal services or reimburse the Community for the costs of such services as set forth herein.
A. 
Reimbursement for streetlighting shall be calculated as either the Borough's actual per light cost or the Community's actual per light cost, whichever is less. The Borough shall reimburse the Community for the costs associated with four roadway intersection sodium vapor streetlights.

B. 
No reimbursement shall be made for the cost of installation or maintenance of lamps, standards, wiring or other equipment.
A. 
The rate of reimbursement for snowplowing is based on the last three-year average cost for snowplowing/sanding/salting of 45,525 feet of municipal roadways. In addition, there are 2,350 feet of road in the Chestertowne Development. The reimbursement is calculated based upon the cost per foot of road multiplied by the amount of roadway within the condominium development.
B. 
The reimbursement formula for snowplowing shall be utilized in the event that the Borough determines, in the Borough's sole discretion, to reimburse the Community for such snow removal services rather than providing such services directly.

The Borough of Chester shall reimburse the Community for services not provided by the Borough, as set forth in the municipal services agreement between the Borough and the Community, within 60 days of the receipt of the Community's properly documented annual accounting and receipts or canceled checks to evidence the Community's payment(s). The amount of the reimbursement check shall be calculated in accordance with the formula established in this ordinance.
