[HISTORY: Adopted by the Mayor and Council of the Borough of Emerson 5-28-1974 by Ord. No. 628 (Ch. 14 of the 1966 Code). Amendments noted where applicable.]
There shall be in and for the Borough of Emerson a Board of Health in accordance with the provisions of the Act of the legislature of New Jersey entitled "An Act to Establish in This State Boards of Health and a Bureau of Vital Statistics, and to Define Their Respective Powers and Duties," approved March 31, 1887, and the several supplements thereto.[1]

Said Board of Health shall consist of five members. The first named member shall hold said office for one year; the second and third named members shall hold said office for two years; and the fourth and fifth named members shall hold said office for three years. All members of said Board hereafter appointed shall be appointed by the Council and shall hold said office for terms of three years, except in the case of vacancies. Vacancies shall be filled for the unexpired term.

Said Board of Health shall reorganize at the first meeting in January and shall adopt rules and regulations for its own government and shall elect a President and Vice President from among its own Board members.

Said Board of Health shall annually appoint a Registrar of Vital Statistics, Secretary, Health Officer, Registered Environmental Health Specialist, Public Health Nurse and may also appoint such other officers or assistants as said Board of Health may deem necessary. All appointees of said Board of Health shall be governed by the rules of said Board and they may be removed for cause by said Board.

The members of the Board of Health shall receive no compensation for their services as members of the Board of Health.

The Board of Health may adopt rules, regulations or ordinances for its government and for the government of its officers and employees not inconsistent with law or the state Sanitary Code.

The Board of Health shall annually, before January 31 in each year, forward to the Borough Council a proposed budget of the Board of Health for the current calendar year. The Board of Health shall also, prior to December 21 in each year, make a report to the Borough Council of its financial transactions and accounts and advise the Council as to what reserve, if any, of budget appropriations of the Board of Health ought to be established by the Council.

Said Board of Health shall not contract any debt or debts of any kind beyond the amount of the appropriation made for its use by the Council.

It shall be the duty of said Board to keep full minutes of its proceedings and to make a report thereof to the Borough Council at it first meeting in November and May annually and also to report in detail the items of its expenses.
