A. 
Each municipal police officer, sworn and employed by the Township of Nether Providence Police Department, has the power and authority to enforce the laws of the Commonwealth of Pennsylvania as outlined in 42 Pa.C.S.A. § 8952(1) and (2).
B. 
The municipal police officers, who are outside their primary jurisdiction, shall have the power and authority to perform the functions of the office and enforce the laws of the Commonwealth of Pennsylvania, as outlined in 42, Pa.C.S.A. § 8953(a)(1), (2), (3), (4), (5) and (6)(b) and (c).
Each municipal police officer, sworn and employed by the Township of Nether Providence Police Department shall, under 42 Pa.C.S.A. § 8902, for the following offenses, upon view, have the power and authority and the right of arrest without warrant, upon probable cause, when there is ongoing conduct that imperils the personal security of any person or endangers any public or private property.
A. 
Under Title 18 when such an offense constitutes a summary offense:
(1) 
18 Pa.C.S.A. § 5503 (relating to disorderly conduct).
(2) 
18 Pa.C.S.A. § 5505 (relating to public drunkenness).
(3) 
18 Pa.C.S.A. § 5507 (relating to obstructing highways and/or public passages).
(4) 
18 Pa.C.S.A. § 6308 (relating to purchase, consumption, possession or transportation of liquor, malt or brewed beverages).
A. 
Whenever a police officer comes in contact with any person which the officer has probable cause to believe is in violation of any of the above-listed summary offenses and said violator's continued conduct or demeanor imperils the personal safety of any person, including that of the violator, or endangers any public or private property, the officer shall take that person into custody as if arrested with a warrant.
B. 
Persons arrested for summary violations, who are 18 years or older, shall be released when their action or demeanor demonstrates that they are no longer a threat to persons or property. In the event that such a person continues to exhibit behavior which is endangering to persons or property after 16 hours have passed, that person shall be taken before a District Justice for adjudication or to the appropriate Mental Health Commitment Center whichever is most appropriate.
C. 
Persons arrested for summary violations, who are under 18 years of age, shall be released only to a parent or guardian or other responsible adult.
