The Rules and Regulations of the Easton Area Joint Sewer Authority,[1] adopted on December 19, 1988, and as amended on July 17, 1989, shall henceforth control and be applicable to all sewerage originating within the geographical boundaries of the Township of Palmer, provided that the last sentence of Section 13 thereof relating to indemnification of the Easton Area Joint Sewer Authority is expressly disapproved and not adopted herein.

A. 
Any user who is found to have violated an order of the Authority or Palmer Township or who willfully or negligently fails to comply with any provision of this ordinance or the orders, rules, regulations and permits issued hereunder shall, upon summary conviction, be fined not less than $500. nor more than $1,000. for each offense. Each day on which a violation shall occur or continue shall be deemed a separate and distinct offense. In addition, the Township may recover reasonable attorneys fees, court costs, court reporter's fees and other expenses of litigation by appropriate suit of law against the person found to have violated this ordinance or the orders, rules, regulations and permits issued hereunder.
B. 
Any person who knowingly makes any false statements, representation or certification of any application, record, report, plan or other document filed or required to be maintained pursuant to this ordinance or permit or who falsifies, tampers with or knowingly renders inaccurate any monitoring device or method required under these rules under this ordinance, upon conviction, shall be punished by a fine of not less than $500. nor more than $1,000. In addition, the Township may recover reasonable attorney's fees, court costs, court reporter's fees and other expenses of litigation by appropriate suit of law against the person found to have violated this ordinance or the orders, rules, regulations and permits issued hereunder.
All previous rules, regulations, motions, resolutions or ordinances or parts thereof inconsistent or conflicting with any part of this ordinance are hereby repealed to the extent of such inconsistency or conflict.
If any provision, paragraph, word or section of this ordinance is invalidated by any court of competent jurisdiction, the remaining provisions, paragraphs, words and sections shall not be affected thereby and shall continue in full force and effect.

The Easton Area Joint Sewer Authority shall have full authority and responsibility for permitting, monitoring, inspecting, sampling, establishing industrial waste surcharges and promptly advising the Township of all violations of any sewer rules, regulations, ordinances and statutes applicable to the Township.
