No person or persons shall distribute any circulars or advertising bills of any kind or character within the corporate limits of the Borough of Pen Argyl without first having obtained from the Borough Secretary a permit so to do. The cost of such a permit is to be fixed by resolution of the Borough Council.
No permit shall be issued to any person for the distribution of circulars or advertising matter except upon agreement on the part of said person or persons to place said circulars or other advertising matter in envelopes, sealed or unsealed, which envelope or envelopes shall not be thrown upon the porch or yards of any property in the Borough but shall be placed by the distributor in the residence for which it is intended.
The term "any person or persons" as used in this chapter shall include the person actually engaged in distribution as well as the manager, proprietor or executive officer of any firm or corporation responsible for the distribution of said circulars or advertising matter.
Any person or persons distributing circulars or advertising matter within the corporate limits of the Borough without first having obtained a permit therefor, or, having obtained such permit, causing or allowing said circulars or advertising matter to be distributed contrary to the provisions of § 63-2 hereof, shall be guilty of a violation of this chapter and, upon conviction in summary proceedings, shall be subject to a fine of not less than $50 nor more than $300 and costs of prosecution, and upon default in payment thereof, shall be sentenced to the county jail for a period of not more than 30 days.
